RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BAKERSFIELD REQUESTING THE STATE
LEGISLATURE TO AMEND STATE LAWS PERTAINING
TO SAFE ZONES.
WHEREAS, over the past years, gang activity has increased in the city; and
WHEREAS, gangs have an injurious effect on urban areas due to the increases
in violent and drug-related offenses; and
WHEREAS, the California Legislature has adopted legislation in the, Penal Code
regarding gang-related crimes and enhanced punishment when such criminal activity is
conducted within certain areas (Penal Code Section 186.22); and
WHEREAS, pursuant to that legislation, gang-related crimes committed within
1000 feet of schools where minors are present carry enhanced punishments; and
WHEREAS, the City of Bakersfield believes citizens deserve to live without fear
of violent crime and to enjoy safe schools and parks; and
WHEREAS, there is no mention in the adopted legislation of enhanced
punishment for gang-related crimes committed in and around parks; and
WHEREAS, in past years, there has been increased violent gang-related activity
in and around the City's parks; and
WHEREAS, there is no mechanism in place for enhancing the punishment for
violent gang-related crimes committed in and around the City's parks; and
WHEREAS, the City of Bakersfield desires to see the legislation amended to
protect patrons of the City's parks in the same manner as children attending schools.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Bakersfield as follows:
1. That the above recitals are true and correct;
2. That the Council requests the California Legislature to amend Penal Code
Section 186.22 to include publicly-owned parks as areas which will result
in enhanced sentences for the commission of gang-related crimes.
3. Staff is directed to contact our local state legislators and propose such an
amendment.
