The appeal must be filed in writing within 10 days from date of the Board’s hearing with the City Council, c/o City Clerk; 1501 Truxtun Avenue; Bakersfield, CA 93301. Appellants, except those within the public notice area, must include a $675 non-refundable filing fee with the appeal. If all appeals are withdrawn before the City Council’s meeting, they will not hear the item and the Boards decision will become final. = The City will not issue any permit, license or other approval for a use involved in an application until after the appeal period has closed. If the City Clerk does not receive an appeal within the 10- day period, the Board’s decision will become final. 2. CONDITIONAL USE PERMITS 1) File No. 05-1904 - Conditional Use Permit to construct a 2,092 sq. ft. (Ward 2) duplex on a 5,625 sq. ft. site located in a C-1 (Neighborhood Commercial) zone. Staff Recommendation: Approve 2) File No. 06-0957 – A Conditional Use Permit to allow a 1,056 sq. ft. sales (Ward 7) facility for a 2 year period of time for Tract 6367 in an R-1 (One Family Dwelling) zone district. Staff Recommendation: Approve 3) File No. 06-0981 -- Conditional Use Permit to increase the number of (Ward 6) residents in a licensed group home (ages 13 to 17 years old) from 6 to 8 with 2 staff members in a 4 bedroom, 2,100 sq. ft. house in an R-1 zone district. Staff Recommendation: Approve 4) File No. 06-1050 – A Conditional Use Permit to allow a 1,440 sq. ft. sales (Ward 6) facility for a 2 year period of time for Tract 6170 in an R-1 (One Family Dwelling) zone district. Staff Recommendation: Approve 5) File No. 06-1067 – A Conditional Use Permit to allow a model home (Ward 3) complex consisting of two 1,140 sq. ft. sales/design centers for a 2 year period of time for Tract 6338 in an R-1 (One Family Dwelling) zone district. Staff Recommendation: Approve 6) File No. 06-1068 – A Conditional Use Permit to allow a 1,140 sq. ft. sales (Ward 3) facility for a 2 year period of time for Tract 6485 in an R-1 (One Family Dwelling) zone district. B.MODIFICATIONS 1) File No. 06-0569 -- A zoning Modification to allow a reduction in parking (Ward 5) from 525 parking spaces to 315 parking spaces for a proposed 65,595 sq. ft. multiple tenant medical office in the C-O (Professional and Administrative Office) zone district located at 9900 Stockdale Highway. (Continued from June 13, 2006) Staff Recommendation: Approve 2) File No. 06-0821 -- A zoning Modification to allow 15 and 20 front yard (Ward 3) setbacks where a minimum of 25-feet is required on a total of 70 of 426 lots in Tentative Tract No. 6406 in the R-1 (One-Family Dwelling) zone district located at the SE corner of Panorama Drive & Vineland Road – Tract 6406. (Continued from June 13, 2006) Staff Recommendation: Approve 3) File No. 06-1105 -- A zoning Modification to reduce the required front yard (Ward 4) setback along Jackson Lake Drive from 25 feet to 22.57 feet in order to maintain a 10 foot radius setback from an abandoned oil well for a single- family residence in an R-1 (One-Family Dwelling) zone district.
