ROLL CALL 1. BOARD MEMBERS: Present: GEORGE GONZALES, Chairperson PHIL BURNS Absent: RAUL ROJAS STAFF MEMBERS: Present: JIM EGGERT, Principal Planner BOB SHERFY, Deputy City Attorney GEORGE GILLBURG, Engineer II ISABEL WILLIAMS, Recording Secretary The Chairperson read the Notice of Right to appeal as set forth on the agenda. PUBLIC STATEMENTS 2. None MINUTES OF PREVIOUS MEETING 3. Motion was made by Member Burns to approve minutes of the meeting held February 14, 2006. Motion carried. PUBLIC HEARING - FILE NO. 06-0181 PAUL DHANENS ARCHITECT, INC. 4.A.1. HAS REQUESTED A CONDITIONAL USE PERMIT TO RECONSTRUCT, RECONFIGURE, & ENLARGE CLASSROOMS TO ALLOW A PRESCHOOL FOR 43 CHILDREN, AND A DAYCARE FOR 15 SCHOOL AGE STUDENTS AT AN EXISTING CHURCH FACILITY IN AN R-1 (ONE FAMILY DWELLING) ZONE LOCATED AT 2906 LOMA LINDA DRIVE. Staff report was given. Staff Planner, Jim Eggert referred to a correction on page 5, II, item 3. Public hearing was opened. Joe Phram representing Temple Beth El read into the record a letter from Kathy Skolls, 2918 Loma Linda. He also requested phasing the wall improvements and waiving the requirement for sidewalks. Richard Shill member of the temple spoke in favor. Minutes, BZA, 3/13/06 Page 2 Brenda Bosley, 133 El Cerrito Drive stated she was not against the project but was concerned with the noise that comes from the playground. She was in favor of staff's recommendations concerning the block wall and landscaping. Terry Holdner, President of the temple spoke in favor. In rebuttal, Brenda Bosley reiterated to the Board her and her neighbor's concerns regarding noise from the playground. There being no others wishing to speak, public hearing was closed. Mr. Burns noted that he agreed with the recommendation from staff regarding installation of the wall. He also stated that sidewalks were important to be installed to keep pedestrians from being out in the street. Motion was made by Member Burns to adopt the attached resolution with all findings and conditions, approving Conditional Use Permit #06-0181 as revised and conditioned by staff, and modify Exhibit A II, item #2, deleting the last sentence. Motion carried by the following roll call vote: AYES: Burns, Gonzales ABSENT: Rojas 4.A.2) PUBLIC HEARING - FILE NO. 06-0192 - CONDITIONAL USE PERMIT REQUESTED BY CINDY HO TO ALLOW THE ON-SITE CONSUMPTION OF ALCOHOL AT AN EXISTING RESTAURANT ZONED C-1 (NEIGHBORHOOD COMMERCIAL) LOCATED AT 1652 OAK STREET. Staff report was given. Public hearing was opened. There was no one present to speak either in favor or opposition, public hearing was closed. Motion was made by Member Burns to adopt the attached resolution with all findings and conditions, approving Conditional Use Permit no. 06-0192 as depicted in the project description. HUCKABY AND DANETTE REYNOLDS TO ALLOW A SOBER LIVING FACILITY FOR 12 RESIDENTS AND REDUCE THE REQUIRED PARKING FROM 11 SPACES TO 8 SPACES IN AN R-1 (ONE FAMILY DWELLING) ZONE DISTRICT LOCATED AT 2309 SAN MARINO DRIVE. Staff report was given. Public hearing was opened. Lynn Huckaby represented the applicant, stated he agreed with staff's recommendation. There being no others to speak, public hearing was closed. Motion was made by Member Burns to adopt the attached resolution with all findings and conditions, approving Conditional Use Permit 06-0230 as depicted in the project description. Motion carried by the following roll call vote: AYES: Burns, Gonzales ABSENT: Rojas 4.B.1) PUBLIC HEARING - FILE NO. 06-0164 - MODIFICATION REQUESTED BY LPN ARCHITECTS TO REDUCE THE REQUIRED NUMBER OF PARKING SPACES FROM 80 SPACES TO 76 SPACES TO PERMIT THE CONSTRUCTION OF A HOT TUB AT AN EXISTING HOTEL LOCATED IN A C-2 (REGIONAL COMMERCIAL) ZONE DISTRICT LOCATED AT 3600 CHESTER LANE. Staff report was given. Public hearing was given. Allen Whittenbaugh, project archtiect was present, as well as Kate Flynn, Traffic Engineer for the project. There being no others wishing to speak, public hearing was closed. Member Burns commented that the parking study was done very well. Minutes, BZA, 3/16/06 Page 4 Motion was made by Member Burns to adopt the resolution with all findings and conditions, approving Modification 06-0164 as depicted in the project description. Motion was carried by the following roll call vote: AYES: Burns, Gonzales ABSENT: Rojas 4.B.2) PUBLIC HEARING - FILE NO. 06-0245 - A MODIFICATION REQUESTED BY BRIAN ALEXANDER TO REDUCE THE REQUIRED WEST SETBACK FROM 50 FEET TO 37 FEET TO PERMIT THE CONSTRUCTION OF TWO 4-PLEX BUILDINGS IN AN R-2 (LIMITED MULTI-FAMILY DWELLING) ZONE DISTRICT LOCATED AT 13312 & 13313 RISSY COURT. Staff report was given. Public hearing was opened. Applicant, Brian Alexander was present. There being no others present to speak, public heairng was closed. Motion was made by Member Burns to adopt the attached resolution with all findings and conditions, approving Modification 06-01245 as depicted in the project description.
