RESOLUTION OF INTENTION NO. 1174 PRELIMINARILY
ADOPTING, CONFIRMING AND APPROVING PUBLIC
WORKS DIRECTOR'S REPORT FOR THE TRAFFIC SIGNAL
MAINTENANCE DISTRICTS AND THE 1998-99 BUDGETS;
SETTING TIME AND PLACE FOR HEARING PUBLIC
TESTIMONY AND PROTESTS ON THE AMOUNT OF
ASSESSMENTS TO BE LEVIED THROUGHOUT EACH OF
THE TRAFFIC SIGNAL MAINTENANCE DISTRICTS.
(WARD 4)
WHEREAS, Chapter 13.04 of Title 13 of the Municipal Code of the City of
Bakersfield provides for an alternative procedure by which the City Council may provide
for the payment of the whole or any part of the costs and expenses of maintaining and
operating any public improvements which are local in nature, from annual benefit
assessments apportioned among the several lots or parcels of property within the
maintenance district established therefore; and
WHEREAS, the Council approved Resolution 161-94 on September 28,
1994, which provides for the collection of maintenance and operating costs for
"convenience" traffic signals; and
WHEREAS, the Public Works Director has on this date filed with the Clerk
of said Council his Report, attached hereto and incorporated herein by reference as Exhibit
"1", containing the following:
(a)
a description of the property in each of the Traffic Signal Maintenance
Districts, attached hereto as Exhibits "A" and incorporated as though
fully set forth;
(b)
the improvements to be maintained by each district specifically are
traffic signal(s) which benefit the areas within the boundaries as
shown on Map and Assessment Diagram for each of the Traffic Signal
Maintenance Districts, attached hereto as Exhibits "B" and
incorporated as though fully set forth;
(c) the Benefit Formula set forth as Exhibit "C"; for each district,
(d)
a Budget, Exhibit "D," containing the matters specified in Section
13.04.130 of the Bakersfield Municipal Code; for each district, and
(e)
the amount of assessment to be levied against each parcel and
incorporated as though fully set forth; Exhibit "E", for each district.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Bakersfield, State of California, as follows:
The foregoing recitals are true and correct and are incorporated
herein.
2. The City Council hereby reserves the right to perform the work of
maintenance and operation of the public improvements within each of the Traffic Signal
Maintenance Districts by City forces or by private contractor. Such determination and
election is to be made for each year at the time the budget and assessment is approved
for the year in question.
3. The City Council hereby preliminarily adopts and approves the Public
Works Director's Report and declares that the territory within the boundaries so specified
and described are the Traffic Signal Maintenance Districts which benefit from said local
improvements; that the expense of maintaining and operating said improvements is hereby
made assessable upon each district; and that the extedor boundaries of said Traffic Signal
Maintenance Districts are hereby specified and described to be as shown on those certain
maps now on file in the Office of the City Clerk of the City of Bakersfield and in the Office
of the Public Works Director, marked Exhibits "B," attached hereto and incorporated in this
resolution as though fully set forth herein, entitled "Map and Assessment Diagram for
Traffic Signal Maintenance District, Bakersfield, California" which maps indicate by a
boundary line the extent of the territory included in each district and shall govern for all
details as to the extent of the maintenance districts.
4. The City Council hereby fixes WEDNESDAY, June 10, 1998, AT 7:00
P.M., as the time to hear public testimony and also sets WEDNESDAY, June 24, 1998,
AT 7:00 P.M., or as soon thereafter as may be heard, at the Council Chambers of the City
Council, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for hearing
protests on the following matters:
FAIRNESS OF THE BENEFIT FORMULA;
THE AMOUNT OF THE ASSESSMENT ON ANY PARCEL OF PROPERTY
TO BE ASSESSED;
RESERVATION BY CITY OF RIGHT TO ELECT WHETHER TO PROCEED
TO PERFORM WORK BY CITY FORCES OR BY PRIVATE CONTRACTOR.
Any interested person may object to any of the above-listed matters by filing
a wdtten protest with the City Clerk at 1501 Truxtun Avenue, Bakersfield, California, at or
before said time set for the protest hearing; and said City Clerk shall endorse on each
protest the date and hour of its receipt, and at said time appointment for said hearing shall
present to the Council all such protests filed with said Clerk.

hearing to be published, and mailed in the manner prescribed by Sections 13.04.150
through 13.04.17'0 of the Bakersfield Municipal Code, said notice to be completed not less

NOTICE IS HEREBY GIVEN that the PublicWorks Director of the City of Bakersfield has prepared and filed with
the City Clerk a Report which provides the basis for the benefit assessment for maintaining and operating traffic
signal(s) improvements to be borne by all parcels of property within each of the Traffic SignaiMaintenance Districts
which includes your property.
The estimated revenue to be raised for this fiscal year for the Traffic Signal Maintenance District is:

Two hearings will be held regarding the Traffic Signal Maintenance District. The first will be a public testimony
hearing at which time any comments regarding the following will be heard: the boundaries of the district; the
fairness of the benefit formula; thezones of benefit; the reservation of right by the City to utilize either City forces
or to contract with private industry for the operation and maintenance of the improvements; or the amount of the
assessment on any parcel of property to be assessed. This hearing will be held on Wednesday, June 10, 1998,
at 7:00 P.M., or as soon thereafter as the matter may be heard in the Council Chambers at 1501 Truxtun Ave.
The second hearing will be a protest hearing at which time only protests will be heard. The Public Works Director~
report will be heard at this hearing. Any interested owner objecting to any of the items listed in the preceding
paragraph may file a written protest, signed by him/her, describingthe parcel of property so that it may be identified
and stating the grounds of his/her protest. Any written protest shall be filed with the City Clerk at 1501 Truxtun
Avenue, Bakersfield, California, 93301 at or before the protest hearing. Individuals nay also appear and be heard
at the hearing. This hearing will be held onWednesday, June 24, 1998, at 7:00 P.M.or as soon thereafter as the
matter may be heard, in the Council Chambers at 1501 Truxtun Avenue.
Any person challenging in court the decision made at the conclusion of such public hearing may be limited to
raising only those issues raised at such hearing or in correspondence delivered to the City of Bakersfield prior to
close of such hearing.

TRAFFIC SIGNAL MAINTENANCE DISTRICTS

Fiscal Year 1998-99
City of Bakersfield Traffic Signal Maintenance Districts, TS-1 (Marketplace),
TS-2 (NW Promenade) and TS-3 (Rosedale, Jet Way) are generally described in Exhibits
"A" and are specifically as shown on the Map and Assessment Diagram under Exhibits "B",
attached hereto and incorporated herein by reference as though fully set forth, as Traffic
Signal Maintenance Districts within the City of Bakersfield, County of Kern, State of
California.
Pursuant to the provisions of Chapter 13.04 of Title 13 of the Municipal Code
of the City of Bakersfield, the Public Works Director makes and files this Report and
proposed assessment of and upon all parcels of property within the districts for the cost
of maintaining and operating traffic signals that benefit the vadous districts. The
assessment includes the cost to operate, maintain, repair and replace signal poles, mast
arms, signal heads, controller, cabinet, machine vision detection system, street light
luminaires, conduits, wires and pull boxes, cost of energy, supervision and any and all
other items necessary for the proper maintenance and operation thereof.
Developers often request permission to install traffic signals on major streets
to enhance access to their development. These "convenience" traffic signals are not
required by the Traffic Authority to regulate traffic flow, but are installed solely at the
discretion of the developer of a commercial site. Such signals do not provide a general
public traffic benefit.
Under the "user pay" concept, the private property deriving benefits should
bear the costs of maintenance and operation of convenience traffic signals. On September
28, 1994 the City Council approved Resolution 161-94 instituting the collection of
maintenance and operating costs of future convenience traffic signals through
maintenance districts.
The traffic signals that are operated and maintained under these
maintenance districts benefit the parcels within the various districts. Each parcel is
assessed on a tdp generation basis throughout each district. The benefit formulas are set
forth herein as Exhibits "C" and attached hereto and incorporated in this resolution as
though fully set forth herein.

BENEFIT FORMULA
Each parcel shall be assessed a percentage of the total operating and maintenance costs proportional to the
trips generated by that parcel using the signalized intersection, adjusted for prior year fund balance or deficit.
The Marketplace shopping center is divided into 5 zones (see next page). The percentage of trips of each
zone using the signalized intersection is shown below:
Zone 1 20%
Zone 2 50%

The amount to be assessed to each parcel is calculated as follows:
( 1 ) Calculate the total number of trips generated by each building using the City Average Daily Trips
(ADT) rates.
(2) Multiply the number of trips of each building by the percentage of the zone shown above.
(3) Add the total number of trips (2) of all buildings in each parcel.
(4) Add the total number of trips (2) of all buildings in all zones.
(5) Divide the total number of trips of each parcel (3) by the total number of trips in all zones (4). This
is the proportionate share of the total assessment for each parcel.
(6) Multiply the result of (5) times the total cost of the district lbr each parcel. This is the amount to be
assessed to each parcel.

Each parcel shall be assessed a percentage of the total operating and maintenance cost proportional to the
trips generated by that parcel, adjusted for prior year fund balance or deficit.
The amount to be assessed to each parcel is calculated as follows:
(1) Calculate the total number of trips generated by each building using the City Average Daily Trips
(ADT) rates.
(2) Add the total number of trips I 1) of all buildings in each parcel.
(3) Add the total number of trips (2) of all buildings in all parcels.
Divide the total number of trips of each parcel (2) by the total number of trips in all parcels (3).
This is the proportionate share of the total assessment for each parcel.
{5) Multiply the result of (4) times the total cost of the district for each parcel. This is the amount to
be assessed to each parcel.
Assessment amounts could vary substantially during the initial development of the shopping center. Since
only the developed parcels will generate traffic using the signalized intersection, those parcels will be
responsible for the entire cost of the district. None of the parcels will be assessed for the 1998-99 fiscal
year since the signals are not in operation. Any costs incurred in the 1998-99 fiscal year will be carried
over to 1999-2000.

14) Divide the total number of trips of each parcel (2) by the total number of trips in all parcels (3).
This is the proportionate share of the total assessment for each parcel.
(5) Multiply the result of (4) times the total cost of the district for each parcel. This is the amount to
be assessed to each parcel.
* Since Rosedale Highway is a state highway, the state pays 2/3rds of the cost of the signal on Rosedale
and the district pays 1/3rd. The district pays all of the cost of the signal on Coffee Road.
Assessment amounts could vary substantially during the initial development of the shopping center. Since
only the developed parcels will generate traffic using the signalized intersections, those parcels will be
responsible for the entire cost of the district. Any costs incurred prior to the first development will be
spread on a per acre basis. None of the parcels were assessed for the 1997-98 fiscal year since the signals
were not in operation at the beginning of the fiscal year. Any costs incurred in the 1997-98 fiscal year will
be carried over to 1998-99.
