A RESOLUTION DECLARING REAL PROPERTY
SURPLUS TO THE NEEDS OF THE CITY AND
AUTHORIZING THE FINANCE DIRECTOR TO
NEGOTIATE ITS SALE
WHEREAS, on November 10, 1994 the City acquired through the annexation process,
the underlying fee ownership of approximately 6,144.27 square feet of excess road right of way
created by the vacation of Hayes Street; and,
WHEREAS, the owner of the adjacent parcel has requested the City sell this property
described in Exhibit "A' attached hereto to incorporate into owners development.
WHEREAS, on September 21, 2000 the Planning Commission found the sale of this
property to be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to
Government Code Section 65402.
WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale of City
property deemed to be "surplus".
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The foregoing findings and recitals are true, correct, and incorporated herein.
Real Property located along Hayes Street, between East Brundage Lane and State
Route 58 is hereby declared surplus to the City's needs and the Finance Director is
authorized to negotiate its sale. The real property is more fully described in
Exhibits "A' and "B" artached hereto and incorporated as though fully set forth.

the City Council of the City of Bakersfield at a regular meeting thereof held on

CITY OF BAKERSFIELD FEE OWNED PORTION OF
RIGHT OF WAY FOR HAYES STREET
That portion of Lot 3 and adjoining road right of way for Hayes Street as Lots and Streets are
shown on "Map of Industrial Acres" filed for record April 9, 1925, in Book 3 of Maps at page
120, in the Office of the Kem County Recorder, also being a portion of the northeast 1/4 of
Section 5, Township 30 South, Range 28 East, M.D.M., City of Bakers field, County of Kern,
State of California, more particularly described as follows:
Commencing at the southwest comer of said Lot 3, also being a point on the easterly right of way
line of Hayes Street;
Thence N 41 ° 12' 50" E, along the westerly line of said Lot 3 .(and easterly fight of way line of
Hayes Street), a distance of 59.69 feet to intersect the north right of way line of State Freeway 58
(State Route VI-KER-58) as established by "Relinquishment of Highway Right of Way in The
County of Kern, Road 06-KER-58-R 52.3/R 55.4 Request No. 79372" filed for record in Book
5045, Page 1079, Official Records, in the Office of the Kern County Recorder, said point being
THE TRUE POINT OF BEGINNING;
THENCE N 48° 47' 10" W, 30.00 feet to intersect the center line of Hayes Street;
THENCE N 41 o 12' 50" E, along said center line, a distance of 108.18 feet;
THENCE S 48° 47' 10" E, a distance of 30.00 feet to intersect the easterly fight of way line of
Hayes Street;
THENCE S 00° 07' 10" W, a distance of 81.53 feet to intersect the north right of way line of
State Freeway 58;
THENCE N 89° 52' 50" W, along said north right of way line, a distance of71.11 feet to the
TRUE POINT OF BEGINNINO.
