HomeMy WebLinkAboutRES NO 126-00RESOLUTION NO._ 12 6- 0 0 A RESOLUTION DECLARING REAL PROPERTY SURPLUS TO THE NEEDS OF THE CITY AND AUTHORIZING THE FINANCE DIRECTOR TO NEGOTIATE ITS SALE WHEREAS, on November 10, 1994 the City acquired through the annexation process, the underlying fee ownership of approximately 6,144.27 square feet of excess road right of way created by the vacation of Hayes Street; and, WHEREAS, the owner of the adjacent parcel has requested the City sell this property described in Exhibit "A' attached hereto to incorporate into owners development. WHEREAS, on September 21, 2000 the Planning Commission found the sale of this property to be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to Government Code Section 65402. WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale of City property deemed to be "surplus". NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The foregoing findings and recitals are true, correct, and incorporated herein. Real Property located along Hayes Street, between East Brundage Lane and State Route 58 is hereby declared surplus to the City's needs and the Finance Director is authorized to negotiate its sale. The real property is more fully described in Exhibits "A' and "B" artached hereto and incorporated as though fully set forth.
