HomeMy WebLinkAboutRES NO 79-98RESOLUTION NO. ~ 9 - ~)' O RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD ORDERING CERTAIN CHANGES AND MODIFICATIONS TO THE ENGINEER'S REPORT FOR ASSESSMENT DISTRICT NO. 96-2 (ALLEN ROAD TRUNK SEWER) WHEREAS, the City Council (the "City Council") of the City of Bakersfield, California, (the "City"), has previously adopted Resolution of Intention No. 1157 (the "Resolution of Intention") on March 25, 1998, pursuant to the provisions of the City Charter, Chapter 13.08 of the Municipal Code and the Municipal Improvement Act of 1913 (the "Act"), being Division 12 of the Streets and Highways Code of the State of California, for the acquisition and/or construction of certain public improvements in a special assessment district designated as ASSESSMENT DISTRICT NO. 96-2 (ALLEN ROAD TRUNK SEWER) (hereinafter referred to as the "Assessment District"); and WHEREAS, subsequent thereto, the City Council did, by Resolution No. 31-98 adopted on March 25, 1998 approve the Engineer's Report in preliminary form as required in the proceedings for the Assessment District; and WHEREAS, prior to the Public Hearing for the Assessment District, the Engineer of Work has refined the scope and extent of the improvements and refined the prices thereof, and at this time an amended assessment roll has been presented showing such modifications and reductions, if any, in the assessments because of the modifications and refinements made; and WHEREAS, the City Council has determined to approve the assessment roll included in the Engineer's Report as presented at this time. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Bakersfield, as follows: SECTION 1. The above recitals are all true and correct. SECTION 2. The City Council hereby orders and approves the changes and modifications set forth in the Engineer's Report as presented at this time, constituting refinements made to the scope and extent of the improvements and the cost estimates set forth in the preliminary Engineer's Report. The Engineer's Report, the assessment roll, and all related documentation, are all for the best interests of the property owners within the Assessment District, and said assessment, as apportioned, is in accordance with the benefits received, and the Engineer's Report, as presented at this time, is hereby determined to be the final Engineer's Report for all subsequent proceedings relating to this Assessment District. SECTION 4. This resolution shall take effect immediately upon its adoption.
