HomeMy WebLinkAboutRES NO 75-98RESOLUTION NO. 7 5 - 9 8 RESOLUTION DETERMINING THAT A FALL PROTECTION SAFETY SYSTEM FOR THE BAKERSFIELD CENTENNIAL GARDEN ARENA CANNOT BE OBTAINED THROUGH THE USUAL BIDDING PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFOR, NOT TO EXCEED $95,000. VVHEREAS, OSHA requires all facilities to provide fall protection for workers engaged in rigging activities on roof trusses and grid systems; and WHEREAS, fall protection systems are unique to individual designs; and WHEREAS, the architect for Centennial Garden Arena, Rossetti & Associates, hired Evan Corporation to provide initial design and coordination for a fall protection system; and WHEREAS, fall protection systems can only be reasonably be obtained from one vendor because the structural steel framing for the fall protection system for the Centennial Garden Arena is unique in design and has been designed to match up with specific equipment to be installed and is currently being built in an existing facility. VVHEREAS, the Finance Director has determined and has recommended that this Council find, fall protection can only be reasonably obtained from one vendor, Evan Corporation, because of the necessity to integrate the equipment into steel modifications already designed and currently being built, and recommends that this Council authorize dispensing with bidding therefor in accordance with Section 3.20.060 D of the Bakersfield Municipal Code. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: The above recitals are true and correct and incorporated herein by reference. The Council hereby finds that fall protection can only be reasonably obtained from one vendor, Evan Corporation, because of the necessity to successfully integrate the work, supplies, materials and equipment into an existing project: the Centennial Garden Arena The Finance Director is authorized to dispense with the bidding therefor and to negotiate the purchase of same from Evan Corporation, not to exceed $95,000. --Page 1 of 2 Pages-- ORIGINAt I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the City Council of the City of Bakersfield at a regular meeting thereof held on __ JUN !
