A RESOLUTION DISPENSING WITH
BIDDING DUE TO EMERGENCY SEWER
LEAK
WHEREAS, on Saturday, May 9, 1998, the sanitary sewer line at Mount Vernon Avenue, south
of State Highway 58 sprung a leak which threatened to allow sewage to back up and could have affected
residential areas and businesses in the area; and
WHEREAS, City crews were immediately dispatched to the area to attempt to fix the leak and
prevent back-up of the sewer line; and
WHEREAS, on Saturday, May 9, 1998, the Public Works Director was informed that the leak
could not be fixed by City staff alone; and
WHEREAS, the Public Works Director determined that the sanitary sewer line leak would require
outside forces in addition to City staff in order to remedy the problem; and
WHEREAS, the Public Works Director determined that the threat of sewage back-up constituted
an imminent risk to public health, and that the immediate preservation of the public health required the
use of outside forces to repair the leak and insure that no future leak would occur that might pollute
residential areas and businesses in the area; and
WHEREAS, in order to remedy this emergency situation, the Public Works Director authorized
construction services on a time-and-materials basis to construct a bypass system and replace the clay sewer
line in order to prevent reoccurrence of the leakage.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The above recitals are true and correct and incorporated herein by reference.
2. City Council hereby determines that based on the above recitals an emergency impacting
the public health existed thereby allowing the dispensing of bidding requirements or bidding procedures
as set forth in Section 136 of the City Charter and Section 3.20.1)60 of the Bakersfield Municipal Code.
