239-06
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD UPHOLDING THE DECISION OF THE BUILDING
DIRECTOR CONCERNING CONSTRUCTION OF A CARPORT.
WHEREAS, the Appellant, Leroy Petty, constructed a carport on his property
located at 3309 Spring View Street; and
WHEREAS, Code Enforcement for the City of Bakersfield, inspected the above
property on or about April 19, 2006 and determined the carport was constructed in violation of
the Uniform Building Code 106.1 and the Zoning Ordinance 17.08.170; and
WHEREAS, Code Enforcement sent Mr Petty a correction notice on or about
April 20, 2006; and
WHEREAS, a second correction notice was sent to Mr. Petty setting a hearing
for June 6, 2006; and
WHEREAS, a hearing was held on June 6, 2006 before the Building Director,
Phil Burns, who determined that the carport was constructed in violation of the above code
sections; and
WHEREAS, Mr. Burns further determined that Mr. Petty should obtain a
modification from the Board of Zoning Adjustments and obtain a building permit; or,
alternatively remove the carport; and
WHEREAS, on June 16, 2006 Mr. Petty appealed the ruling of the Building
Director to the City Clerk pursuant to Bakersfield Municipal Code section 8.80.11 OB.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
