AN ORDINANCE AMENDING SUBSECTION A.3.B.IV.
OF SECTION 15.66.030 OF TITLE 15 OF THE
BAKERSFIELD MUNICIPAL CODE RELATING
TO DRILLING FOR AND PRODUCTION OF PETROLEUM.
WHEREAS, the City of Bakersfield, filed an application requesting amendment
to Subsection A.3.b.iv of Section 15.66.030 of Title 15 of the Bakersfield Municipal Code
relating to the drilling for and production of petroleum; and
WHEREAS, in accordance with the Bakersfield Municipal Code said amendment
to Title 15 of the Bakersfield Municipal Code was posted and placed on the agenda for the City
Council's regular meeting of May 20, 1998; and
WHEREAS, on April 22, 1998, the City Council held a public hearing related to
General Plan Amendment / Zone Change No. P96-0589 commonly known as the Buena Vista
Project; and
WHEREAS, at said hearing, public testimony was presented expressing concern
with the ability to drill for and produce petroleum from the southwest quarter of Section 12, and
the west half of the southeast quarter of Section 12, T30S, R26E, MDBM which is a portion of
the Buena Vista project and also located within the Canfield Ranch Oil Field; and
WHEREAS, in consideration of and response to said public testimony, the City
of Bakersfield is requesting an amendment to Title 15 as described in order to permit drilling
and production of petroleum in the above described portions of Section 12, T30S, R26E,
MDBM, pursuant to the same regulations of Section 15.066.030 as provided to other adjacent
lands located within the Canfield Ranch Oil Field; and
WHEREAS, Castle and Cooke -California, the property owners, and Stream
Energy Inc., the mineral interest owners, are in agreement to and support the proposed
amendment; and
WHEREAS, the City Council has determined that, in order to encourage
continued oil and gas exploration and production as currently permitted within the above
described portions of Section 12, T30S, R26E MDBM until December 31, 1999, it is necessary
to adopt this ordinance; and
WHEREAS, the City Council has determined that it is in the best interest of the
City to adopt this ordinance to enhance the quality of life and to protect the health, safety and
welfare of its citizens; and
WHEREAS, the law and regulation relating to CEQA and City of Bakersfield's
CEQA Implementation Procedures, have been duly followed by city staff and this Council; and
WHEREAS, staff has determined the proposed amendment is exempt from
CEQA under the provisions of Section 15061 (b)(3) general rule; and
NOW THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
All the foregoing recitals, incorporated herein, are hereby found to be true
and correct.
2. The ordinance amendment is exempt from CEQA pursuant to Section
15061 (b)(3), general rule.
3. The proposed ordinance permits the exploration and provision for natural
resource recovery which is specifically consistent with the Metropolitan Bakersfield 2010
General Plan Conservation Element (Mineral Resources Section-Goals and Policies).
SECTION 1.
Subsection A.3.b.iv. of Section 15.66.030 of the Bakersfield Municipal Code is
hereby amended to read as follows:
3. Class 3 -- the well site and/or production operation is:
b. Located within the state approved boundaries of the following state designated
oil fields as defined by the state D.O.G., regardless of the zone district or distance from
dwellings or public assembly uses as defined in this chapter.
iv. Portion of the Canfield Ranch Oil Field encompassing the west three quarters of
Sections 13 and 24, the southwest quarter of Section 12, and the west half of the southeast
quarter of Section 12, T30S, R26E, MDB&M (D.O.G. Map 413). No well site and/or production
operation proposed after December 31, 1999, shall automatically be considered Class 3, but
shall be evaluated with respect to all class criteria in Section 15.66.030(A) in order to determine
the appropriate permit class and subsequent development standards.
SECTION 2.
This ordinance shall be posted in accordance with provision of the Bakersfield
Municipal Code and shall become effective thirty (30) days from and after the date of its
passage.
