RESOLUTION NO.
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ADOPTING A SERVICE PRIORITY
POLICY FOR LOWER INCOME DEVELOPMENTS IN
ACCORDANCE WITH CALIFORNIA SENATE BILL 1087.
WHEREAS, the California Legislature enacted Senate Bill 1087, "SB 1 087"
which requires providers of water and sewer services to grant priority for these services
to "proposed developments that include housing units for lower income households";
and
WHEREAS, SB 1087 defines "proposed developments that include units for
lower income households" as developments that include dwelling units to be sold or
rented to lower income households;
WHEREAS, SB 1087 further requires that water and sewer providers adopt a
written policy with specific objective standards for meeting the priority requirement for
lower income developments; and
WHEREAS, the City Council by and through the City of Bakersfield Domestic
Water System, and the Waste Water Treatment Plants 2 and 3 Service Areas, desires
to adopt this resolution in order to ensure developments with lower income
developments receive service priority in accordance to SB 1087.
NOW, THEREFORE, BE IT RESOLVED, incorporating the above recitals herein,
by the Council of the City of Bakersfield as follows:
1 . That the above recitals are true and correct.
2. Policy. In accordance with SB 1087 and the exceptions enumerated
therein, the City of Bakersfield by and through the City of Bakersfield Domestic
Water System and the Waste Water Treatment Plants Service Areas shall grant
water and sewer service priority to any "proposed developments that include
units for lower income households." For purposes of this policy, "proposed
developments that include units for lower income households" shall be
developments that include dwelling units to be sold or rented to lower income
households, as defined in Section 50079.5 of the California Health and Safety
Code, at an affordable cost, as defined in Section 50052.5 of the California
Health and Safety Code, or an affordable rent, as defined in Section 50053 of the
California Health and Safety Code. The effective date of this policy is July 1,
2006.
3. Rescission of Conflict Resolutions and Policies. All prior resolutions
of policies inconsistent with this Resolution are hereby repealed but only to the
extent that they conflict with this Resolution.
