ROLL CALL Present: Commissioners Lomas, Johnson, McGinnis, Tragish Absent: Commissioners Blockley, Spencer, Tkac. Advisory Members: Robert Sherfy, James D. Movius, Marian Shaw, Phil Burns Staff: Pamela Elisheva, Dana Cornelius 2. PLEDGE OF ALLEGIANCE: 3. PUBLIC STATEMENTS: None. 4. CONSENT CALENDAR: 4.1.1 Non-Public Hearing Items: Deferred until Thursday's meeting. 4.2 Public Hearing Items: Deferred until Thursday's meeting. 5. Hillside Development (HD) Combining Zone Amendment (Negative Declaration on file)(Item previously continued from July 6, 2006 to August 14, 2006 and then from August 14, 2006 to September 5 & 7, 2006). (Note: The public hearing for this item was closed on July 6, 2006). The public hearing on this item was closed on July 6, 2006, Staff report given. It was noted that Commissioner Spencer had arrived. Jack Brea addressed the Hillside stability issues, Ron Fraze, City Fire Chief, discussed the safety aspects of the ordinance having to do with Hillside fire potential, and Bob Sherfy with the City Attorney's Office addressed the takings issue. Mr. Movius addressed the criteria for the ordinance, the CEQA issue and specifically concentrated on the DKS property. (Break in audio—Commissioner Tragish is now speaking) Commissioner Tragish clarified that before a map is vested it is subject to existing ordinances prior to that time. Staff responded that the Map Act provides that if before an application is deemed complete the City has appropriately noticed an ordinance that may go into effect that as long as it goes into effect before the map is vested it would apply to that map. Commissioner Tragish inquired as to the 900 house scenario and if it is 900 houses from the 1400 figure provided, or the 4000 figure, and if it includes DKS and Trevino properties. Staff responded that based on the designations for Hillside protection in that area, there would be a loss of the ability to build 5361 units, and Staff has indicated around Table 12, that it is probably much closer to 897 worse case units being lost, which would be over the entire area that is being designated as slope protection. Commissioner Spencer inquired if the zone changes are causing some of the confusions with the new ordinance. Staff responded that there is a hillside ordinance in effect which has an HD overlay zone on it now, and pointed out that they are not changing what property is zoned, but are changing the provisions within that HD overlay zone. Commissioner Spencer stated that he thinks they are spending too much time on trying to clarify one Planning Commission — Pre-Meeting September 5, 2006 Page 2 property owners' issues wanting their properties to be clear and free. He stated that he thinks the ordinance is well written and will support it without any changes. There were no other comments. 6. COMMUNICATIONS: None. 7. COMMISSION COMMENTS: Commissioner Tragish thanked Mr. Movius for meeting with him. 8.
