RESOLUTION NO. 2 66 - 0 6
A RESOLUTION DISPENSING WITH BIDDING PROCEDURES DUE TO
EMERGENCY ASBESTOS ABATEMENT WITHIN THE VENTILATION
SYSTEM AT CITY HALL NOT TO EXCEED $175,000 (INITIAL ESTIMATE).
WHEREAS, on Saturday, September 30, 2006, General Services staff completed an
investigation and sampling of material suspected to be asbestos containing material (ACM) in
some equipment that is part of the heating ventilation and air conditioning (HVAC) system
within the ventilation ducts in various locations at City Hall, and
WHEREAS, on Tuesday, October 3, 2006, General Services received a report
concluding that said material was asbestos containing material (ACM) and,
WHEREAS, on Tuesday, October 3, 2006 Dresser Services, the City's on-call
consultant performed extensive air sampling within the City Hall building, and
WHEREAS, on Wednesday, October 4, 2006 General Services received a report
indicating there was no detectable hazardous asbestos in the air within the City Hall building,
and;
WHEREAS, staff determined that emergency abatement procedures were necessary to
protect the public and employees, and;
WHEREAS, the Public Works Director declared this problem an emergency and
authorized A.S.I., Inc, a licensed and bonded asbestos abatement company to abate the
asbestos contamination; Dresser Services to perform air monitoring; and McKenney's Air
Conditioning, Inc. to fabricate and install HVAC duct work. In addition, city staff will also
perform repair/reconstruction work. Work for the three vendors will be on a time-and-materials
basis. Total costs for this project will not to exceed $175,000.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The above recitals are true and correct and incorporated herein by reference.
2. City Council hereby determines that based on the above recitals an emergency
impacting the public health existed thereby allowing the dispensing of bidding
requirements or bidding procedures as set forth in Section 3.20.060 of the
Bakersfield Municipal Code.
