267-06
A RESOLUTION DISPENSING WITH BIDDING PROCEDURES FOR THE
REPAIR OF THE SEWER MAIN ON ALLEN ROAD BETWEEN STOCKDALE
HIGHWAY AND BRIMHALL ROAD, NOT TO EXCEED $550,000 (INITIAL
ESTIMATE) DUE TO IMMINENT THREAT TO PUBLIC HEALTH, SAFETY,
AND WELFARE.
WHEREAS, on Monday October 2, 2006, staff received a report that sewage in some
manholes was higher than normal in the vicinity of Allen Road and Brimhall Road; and
WHEREAS, staff investigated the situation and found the soil around one of the
manholes had collapsed and the sewer main was plugged; and
WHEREAS, staff determined that emergency repairs were necessary to protect the
public; and
WHEREAS, the Public Works Director declared this problem an emergency and
authorized Rain for Rent to establish a bypass system on a time and materials basis not to
exceed $50,000. The Public Works Director also authorized W. M. Lyles, Inc. to repair the
sewer main, on a time and material basis, not to exceed $500,000.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The above recitals are true and correct and incorporated herein by reference.
2. City Council hereby determines that based on the above recitals an emergency
impacting the public health existed thereby allowing the dispensing of bidding
requirements or bidding procedures as set forth in Section 3.20.060 of the
Bakersfield Municipal Code.
