Minutes of the continued meeting of June 18, 1986, of
the Council of the City of Bakersfield, California, held in the
Council Chambers of City Hall at 5:15 p.m., June 23, 1986.
The meeting was called to order by Mayor Payne, followed
by the Pledge of Allegiance.
The City Clerk called the roll as follows:

REPORTS
City Manager Caravalho made an oral report regarding
Budget Review. He provided an overview of the budget process and
indicated that the total budget for all funds, as recommended, is
$134 million.
HEARINGS
This is the time set for public hearing
before the Council for hearing protests
by property owners on the amount of
assessment, the fairness of the benefit
formula, parcels of property to be
assessed or reservation by the City of
its right to elect to perform work of
maintenance by City forces on Maintenance
District No. 1, which provides the basis
for the benefit assessment for main-
taining street landscaping and irrigation
system to be borne by all parcels of pro-
perty within Maintenance District No. 1,
generally extending west from the east
curb line of the median strip of Gosford
Road to the eastern boundary of the
Arvin-Edison Canal and the area extending
south from the south curb line of
Stockdale Highway to the centerline of
Ming Avenue.
Correspondence was received from Alfred F.
R. Escher, 8209 Wimbley Way, dated June 17, 1986, in
to Maintenance District No. 1.

Upon a motion by Councilmember Ratty, Resolution No.
78-86 of the Council of the City of Bakersfield for Maintenance
Distr~ct No. 1 approving and adopting the 1986-87 Budget, levying
assessments, reserving the right to perform maintenance work by
City forces and authorizing collection of Assessments by the Kern
County Tax Collector, was adopted by the following roll call vote:

formula, parcels of property to be
assessed or reservation by the City of
its right to elect to perform work of
maintenance by City forces on Maintenance
District No. 2, which provides the basis
for the benefit assessment for main-
taining within Maintenance District No.
2, generally bounded by Ashe Road on the
east, Ming Avenue on the south, E1 Portal
Drive on the west (including all lots
fronting on El Portal Drive) and
Outingdale Drive/Kearsarge Way on the
north (including all lots fronting
Outingdale Drive and Kearsarge Way).
Correspondence has been received from Mr. & Mrs. John
Romanini, Rt. 1, Box 66, received on June 23, 1986, in protest to
the formula used to set the assessment for the park for
Maintenance District No. 2.
Mayor Payne declared the hearing open for public par-
ticipation. No protests or objections being received, Mayor Payne
closed the public portion of the hearing for Council deliberation
and action.
Councilmember Moore read into the record correspondence
he received from Christina Romanini, as follows:
Dear Council:
Concerning the hearing for Maintenance District No.
2, we object to the formula used to set our
assessment for the park. We own five-p]exes at
7016 and 7024 Ming Avenue that are affected by this
assessment. We have been charged $176.45 or five
times the rate charged a homeowner of a single-
family dwelling for each five-plex.
We feel it is wrong to charge each apartment unit
the same amount as a single family home. We object
to this formula because apartment dwellers are nor-
mally smaller households. Less people per unit will
use the park than people from single-family
dwellings.
We understand this formula is one of the older for-
mulas used in Bakersfield with the newer districts
using a different formula. The newer formula rate
is based on the statistics that 3.24 people reside
in single-family dwellings while only two people
usually reside in an apartment. Thus, the formulas
figured at 3.24 times the rate for single-family
dwellings and two times the rate for each apartment
unit. We feel this new formula is fair and it
assesses the people who actually benefit from the
park their fair amount without overburdening the
owners of apartment complexes. We appreciate the
opportunity to respond to this proposed assessment.

Councilmember Moore made a motion to bring Maintenance
D~strict No. 2 into conformance with the same formula used in
other Maintenance Districts which would result in a charge of
$22.06 versus $35.30. This motion was unanimously approved.

Councilmember Moore made a motion to adopt resolution
approviag budget, confirming assessment and authorizing collection
of assessment by Kern County Tax Collector.
Doug Ayers, of Management Services Institute, explained
the methodology of City-wide Assessment Districts.
Upon a motion by Councilmember Moore, Resolution No.
79-86 of the Council of the City of Bakersfield for Maintenance
district No. 2 approving and adopting the 1986-87 Budget, levying
assessments, reserving the right to perform maintenance work by
City forces and authorizing collection of Assessment by the Kern
County Tax Collector was adopted by the following roll call vote:

parcels of property within Maintenance
District No. 3, generally extending west
from the east curb line of the median
strip of Old River Road and the area
extending north from the Southern Pacific
Railroad right-of-way north to the cen-
terline of White Lane.
Mayor Payne declared the hearing open for public par-
ticlpation.
Kevin Brennon, 9325 Cory Avenue, indicated that the
eastern boundary is Gosford Road, and expressed concern for the
amount of the assessment of $93.00 and the reasoning for it.
Public Works Manager Hawley indicated a change to the
material in the Public Works Manager's Report. Assessments 3484
and 3489 are landscape areas and the assessments should be zero,
which would reduce the budget $183.00. Therefore, the Budget for
1986-87 would be $203,512.00, with a carryover of $59,373.00
resulting in the amount to be assessed of $144,139. The cost to
residents is $91.24.
No protests or objections being received, Mayor Payne
closed the public portion of the hearing for Council deliberation
and action.
Upon a motion by Councilmember Childs, Resolution No.
80-86 of the Council of the City of Bakersfield for Maintenance
District No. 3 approving and adopting the 1986-87 Budget, levying
assessments, reserving the right to perform maintenance work by
City forces and authorizing collection of Assessments by the Kern
County Tax Collector, was adopted by the following roll call vote:

Councilmember Ratty made a motion to adopt resolution

Upon a motion by Councilmember Ratty, the call for the
question failed.

Upon a request by Councilmember Childs, the meeting was
recessed at 7:05 p.m. The meeting was reconvened at 7:26 p.m.
PUBLIC HEARING - REVENUE SHARING FUNDS
Mayor Payne declared the hearing open for pubic par-
ticipation. No protests or objections being received, and no one
wishing to speak in favor, Mayor Payne closed the hearing for
Council deliberation.

There being no further business to come before the
Council, upon a motion by Councilmember Christensen, the meeting
