HomeMy WebLinkAboutORD NO 2903ORDINANCE NO. 2903 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND USE ZOOlING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED 635 FEET NORTH OF STOCKDALE HIGHWAY ON THE WEST SIDE OF COFFEE ROAD. a C-2 (Commercial), has considered said and WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield located 635 feet north of Stockdale Highway on the west side of Coffee Road; and WHEREAS, the Planninq Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject properties from an R-3-D (Limited Multiple Family Dwelling-Architectural Design) Zone to or more restrictive, Zone, and the Council findings and all appear to be true and correct; WHEREAS, environmental impact which could result and WHEREAS, the City Council sideration of said petition and the there appears to be no substantial detrimental from the proposed project; has determined after due con- recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said properties that a zoning chanqe should be authorized; and WHEREAS, the City Counci[ has determined and found that the proposed zoning is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: be 1. All of the foregoing recitals are hereby found to true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain properties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: FROM AN R-3-D (LIMITED MULTIPLE FAMILY DWELLING-ARCHITECTURAL DESIGN) ZONE TO- A C-2 (COMMERCIAL), OR MORE RESTRICTIVE ZONE: PARCEL 1: That portion of the southeast Quarter of Section 32, Township 29 South, Range 27 East, M.D.B.&M., in the City of Bakersfield, Kern County, California, more particularly described as follows: Commencing at the southeast corner of said Section 32, as shown upon Parcel Map No. 5700, as per Map thereof filed December 11, 1980 in the Office of the Kern County Recorder, in Book 26 of Parcel Maps at Page 7; Thence along the east line of said Section North 00°40'51" East (record bearing North 00°01'18" East), 1,185.71 feet; Thence North 89°19'09" West, 55.00 feet to a point on the westerly line of Coffee Road and the Point of Beginning; Thence continuing North 89°19'09" West, 315.81 feet, more or less, to a point on the easterly right-of-way line of the Arvin- Edison Canal, as described in First Amended Final Order of Condemnation recorded December 1, 1966 in the Office of the Kern County Recorder in Book 4000 of Official Records at Page 17; Thence along said easterly right-of-way line South 39°22'48" West, 221.29 feet, to the beginning of curve, concave easterly with a radius of 930.00 feet; Thence southwesterly along said curve, through a central angle of 06029'34", an arc distance of 105.39 feet; Thence South 57006'46" East, Thence South 69°12'14" East, more or less, to a point on 15.00 feet; 529.92 feet, the westerly right-of-way line of said Coffee Road; Thence along said westerly right-of-way line North 01032'56" East, 328.08 feet; Thence continuing along said westerly right- of-way line North 00°40'51" East, 120.71 feet, more or less, to the Point of Beginning. Containinq 3.620 Acres. PARCEL 2: That portion of Section 32, Township 29 South, Range 27 East, M.D.B.&M., described as: Commencing at the intersection of the centerline of Coffee Road with the center- line of Westfield Road as shown on Parcel Map No. 5197, filed October 8, 1979, Book 23, Paqe 165, in the Office of the Recorder of Kern County, State of California; Thence along the centerline of Coffee Road, South 00°01'18" West, 138.67 feet; Thence North 89058'42" West, 55.00 feet to the west right-of-way line of said Coffee Road and the True Point of Beginning; Thence continuing North 89058'42" West, 315.86 feet, more or less, to the east right-of-way line of the Arvin-Edison Canal; Thence North 38044'23" East, 504.98 feet, more or less, to the west right-of-way line of Coffee Road; Thence along said right-of-way line of Coffee Road, South 00°01'18" West, 394.00 feet, more or less, to the True Point of Beginning. Containing 1.43 Acres. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. .......... o0o ..........
