HomeMy WebLinkAboutORD NO 2919ORDINANCE NO. 2919 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE WEST SIDE OF GOSFORD ROAD FROM MING AVENUE SOUTHERLY TO THE ARVIN-EDISON CANAL. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield located on the west side of Gosford Road from Ming Avenue southerly to the Arvin-Edison Canal; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from an A (Agricultural) to an R-2 (Limited Multiple Family Dwelling) or more restrictive Zone, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said property that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that the proposed zoninq is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foreqoinq recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: FROM AN A (AGRICULTURAL) ZONE TO AN R-2 (LIMITED MULTIPLE FAMILY DWELLING) OR MORE RESTRICTIVE ZONE: That portion of land in the east half of Section 8 and in the Northeast quarter of Section 17, Township 30 South, Range 27 East MDB&M more particularly described as follows: Commencing at the intersection of the East right-of-way line of the Arvin-Edison Canal and the South right-of-way line of Ming Avenue, said point also being the True Point of Beginning; Thence East, on and along the South right- of-way line of Ming Avenue the following courses; (1) S 89009'52" E, 588.57 feet; Thence (2) S 88°35'29" W, 300.1 feet; Thence (3) S 83o55'37" E, 120.00 feet; Thence (4) S 89009'52" E, 190.45 feet; Thence S 44°20'21" E, 28.20 feet, to a point on the West right-of-way line of Gosford Road; Thence South, on and along the West right- of-way line of Gosford Road the following courses; (1) S 00°29'10" W, 220.52 feet; Thence (2) $ 00~2]'23" E, 680.07 feet; Thence (3) S 00°29'10" E, 1657.73 feet, to a point on the North line of the Southeast quarter of said Section 8; Thence (4) S 00028'52" W, 282.47 feet; Thence N 89031'08" W, 175.00 feet; Thence S 00078'52" W, 100.00 feet; Thence S 89031'08" E, 175.00 feet, to a point on the West right-of-way line of Gosford Road; Thence South, on and along the West right- of-way line of Gosford Road, the following courses; (1) S 00028'52" W, 2199.54 feet; Thence (2) S 00034'07" W, 65.080 feet, to a point on the North line of the Northeast quarter of said Section 17; Thence (3) S 00034'07" W, 64.982 feet; Thence (4) S 00039'24" W, 1104.39 feet, to a point on the Northerly right-of-way line of Arvin-Edison Canal; Thence Northwesterly, on and along said right-of-way line the following courses; (1) N 70052'30" W, 38.34 feet, beginning of a tangent curve, Northeast, having a radius of to the concave to the 190.00 feet; Thence (2) Northwesterly, on and along said curve, through a central angle of 31041'36", an arc distance of 105.10 feet; Thence (3) N 39010'54" W, 1196.07 the beginning of a tangent curve, the Northeast, having a radius of feet; feet, to concave to 190.00 Thence (4) Northwesterly, on and along said curve, through a central angle of 39053'30", an arc distance of 132.29 feet; Thence (5) N 00042'36" E, 63.56 feet, to a point on the North line of the Southeast quarter of Section 8; Thence (6) N 00°42'36" E, 112.24 feet, to the beginning of a tangent curve, concave the Southwest, having a radius of 310.00 feet; to Thence curve, an arc (7) Northwesterly, on and along said through a central angle of 39°55'31", distance of 216.02 feet; Thence (8) N 39°12'55" W, 365.37 feet, to the beginning of a tangent curve, concave the Northeast, having a radius of 440.00 feet; to Thence (9) Northwesterly on and along said curve, through a central angle of 41016'46", an arc distance of 317.00 feet; Thence (10 N 02°03'51" E, 1760.53 feet, quarter of Section 8; Thence (11 N 02°03'51" E, 1619.67 feet, to the beginning of a tangent curve, concave to the West, having a radius of 1060.00 feet; Thence (12) North, on and along said curve, through a central angle of 01009'30", an arc distance of 21.43 feet; Thence (13) N 00°54'21" E, 371.71 feet, to the beginning of a tangent curve, concave to East, having a radius of 940.00 feet; Thence (14) North on and along said curve, through a central angle of 00051'03", an arc distance of 13.96 feet; Thence (15) N 01045'24" E, 567.12 feet, to a point on the South right-of-way line of Ming Avenue and the True Point of Beginning.
