HomeMy WebLinkAboutORD NO 2925ORDINANCE NO. 2925 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.06.020 OF CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD, REGARDING PREZONING OF PROPERTY KNOWN AS BUENA VISTA NO. 1 ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held hearings on a request by the City of Bakersfield to zone certain proerty now being annexed to said City and made several general and specific findings of fact which warranted a negative declaration of environmental impact; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from this zoning action; and WHEREAS, the proposed zoning substantially conforms to the General Plan; and WHEREAS, the City Council has determined after due consideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the Planning Commission hearing, that said zoning, with the recommended limits on density, should be authorized upon annexa- tion of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: A. All the foregoing recitals are found to be true and correct. B. The Negative Declaration for this zoning action is hereby approved and adopted C. That Section 17.06.020 of Chapter 17.06 Map) of the Municipal Code of the City of Bakersfield, same is hereby amended by extending the boundaries of (Zoning be and the said map to include those certain properties in the County of Kern located contiguous to the boundary of the City of Bakersfield including and south of Fraser Road (While Lane) known as the BUENA VISTA NO. 1 ANNEXATION in an R-1 (One Family Dwelling) Zone, an R-1-CH (One Family Dwelling with Church Zone overlay) Zone, an R-2 (Limited Multiple Family Dwelling) Zone and in an R-3 (Limited Multiple Family Dwelling) Zone upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this Ordinance, and are more specifically described as follows: TO AN R-1 All that portion of the Section 18, Township 30 M.D.M., County of Kern, northwest quarter of South, Range 27 East, State of California, being more particularly described as follows: Commencing at the northwest corner of said Section 18; Thence South 89052'55" east on and along the north line of said Section 18, a distance of 1,308.25 feet; Thence South 00018'20" west, 325.00 feet to the True Point of Beginning; Thence (1) South 00018'20" west, 420.00 feet; Thence (2) South 89052'55" east, 1,461.75 feet more or less to the east line of the northwest quarter of said Section 18; Thence (3) south 00018'20" west on and along said east line a distance of 830.00 feet; Thence (4) north 89052'55" west 2,530.758 feet; Thence (5) north 00°20'00" east, 537.00 feet; Thence (6) south 89°52'55" east, 315.00 feet; Thence (7) north 00020'00" east, 713.00 feet; Thence (8) south 89°52'55" east, 753.70 feet more or less to the True Point of Beginning. Containing 53.36 Acres. TO AN R-1-CH ZONE All that portion of the northwest quarter of Section 18, Township 30 South, Range 27 East, M.D.M., County of Kern, State of California, being more particularly described as follows: 2e Beginning at the north quarter corner of said Section 18; Thence (1) South 00018'20" west, on and along the east line of said northwest quarter, a distance of 745.00 feet; Thence (2) north 89052'55" west, 1,461.75 feet; Thence (3) north 00018'20" east, 745.00 feet more or less to the north line of said Section 18; Thence (4) south 89052'55" east, 1,461.75 feet more or less to the Point of Beginning. Containing 25.00 Acres. TO AN R-2 ZONE All that portion of the northwest quarter of Section 18, Township 30 South, Range 27 East, M.DoM., County of Kern, State of California, being more particularly described as follows: Commencing at the northwest corner of said Section 18; Thence south 00020'00" west, on and along the west line of said Section 18, a distance of 1,038.00 feet to Thence (1) south 89°52'55" east, Thence (2) south 00020'00" west, Thence (3) north 89052'55" west, more or less to the west line of Section 18; the True Point of Beginning; 240.00 feet; 537.00 feet; 240.00 feet said Thence (4) north 00020'00" east on and along said west line, a distance of 537.00 feet more or less to the True Point of Beginning. Containing 2.96 Acres. TO AN R-3 ZONE All that portion of the northwest quarter of Section 18, Township 30 South, Range 27 East, M.D.M., County of Kern, State of California, being more particularly described as follows: Commencing at the northwest corner of said Section 18; Thence south 89°52'55" east, on and along the north line of said Section 18, a distance of 555.00 feet to the True Point of Beginning; Thence (1) continuing along said north line, south 89052'55" east, 753.25 feet; Thence (2) south 00°18'20" west, 325.00 feet; Thence (3) north 89052'55" west, 753.704 feet; Thence (4) north 00020'00" east, 325.00 feet more or less to the True Point of Beginning.
