AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD A~NDING SECTION 5.06.010 A. OF
THE BAKERSFIELD MUNICIPAL CODE RELATING TO
DEFINITIONS - ADULT BOOKSTORES.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Section 5.06.010 A. of the Bakersfield Municipal Code is
hereby amended to read as follows:
5.06.010 Definitions.
A. "Adult bookstore" means a place situated in the
incorporated area of the City in any part of which place the operator
thereof keeps for purposes of sale, rental or display to persons
who enter such place matter which is harmful matter or of a nature
which would justify the finding of a grand jury or magistrate that
there is probable cause to believe such matter to be harmful matter;
provided, however, "adult bookstore" does not mean, and this Chapter
shall not apply to, any business renting and/or selling video tapes
and/or discs, in which there are no facilities for the public to
view such tapes on the premises, in which the proportion of video
tapes and discs which are harmful matter constitute less than
ten percent (10%) of the total tapes and discs displayed on the
premises, and in which no other harmful matter (e.g., books,
magazines, photographs,
displayed.

SECTION 2.
This Ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 29th day of August , 1984, by
the following vote:
