NEW SERIES
AN EMERGENCY ORDINANCE OF THE COUNCIL OF THE
CITY OF BAKERSFIELD AMENDING SECTION 12.44.010
OF THE BAKERSFIELD MUNICIPAL CODE REGARDING
BUSINESS USE OF SIDEWALKS.
WHEREAS, existing ordinances prohibit the sale of
merchandise on streets and sidewalks; and
WHEREAS, certified farmers' markets will provide
commodities at affordable prices; and
WHEREAS, it is anticipated that certified farmers'
markets can best serve the needs of residents through authorized
locations on City streets and sidewalks; and
WHEREAS, the City Council desires to allow such sales
on a trial basis; and
WHEREAS, it is necessary to initiate legislation through
emergency ordinance.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
SECTION 1.
Section 12.44.010 of the Bakersfield Municipal Code is
hereby amended to read as follows:
Section 12.44.010 Unlawful to use for display or storage of
merchandise.
Except as provided hereinafter, it is unlawful for any
person, firm, or corporation to use the public streets or side-
walks of the City, or any portion thereof, for the display for
sale of merchandise, or other articles, except that newspaper
vending machines and any farmers' market certified by the Kern
County Agricultural Commissioner may be allowed upon such streets
or sidewalks as designated by the Public Works Director after
obtaining an Encroachment Permit.
SECTION 2.
This ordinance is declared to be an emergency ordinance
pursuant to Section 24 of the Charter of the City of Bakersfield,
and shall become effective immediately upon its passage.
