HomeMy WebLinkAboutORD NO 2949ORDINANCE NO. 2949 NEW SERIES AN ORDINANCE OF THE COUNCIL OF 'THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTHWEST CORNER OF PANAMA LANE AND STINE ROAD. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield located on the northwest corner of Panama Lane and Stine Road; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from an R-1 (One Family Dwelling) Zone to an R-2 (Limited Multiple Family Dwelling) or more restrictive Zone, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result and WHEREAS, the City Council has from the proposed project; determined after due con- sideration of said petition and the ning Commission herein on file, together with at the hearing for a change of zoning of said zoning change should be authorized; and WHEREAS, the City Council has determined and found that the proposed zoning is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the recommendations of the Plan- the reasons advanced property that a City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: AMENDING THE ZONING BOUNDARIES FROM AN R-1 (ONE FAMILY DWELLING) ZONE TO AN R-2 (LIMITED MULTIPLE FAMILY DWELLING) OR MORE RESTRICTIVE ZONE: That portion of the east half of the southeast quarter of Section 22, Township 30 South, Range 27 East, M.D.B.&M. descri- bed as follows; Commencing at the east Ouarter corner of Section 22, Township 30 South, Range 27 East, M.D.B.&M said point also being the intersection of the centerlines of Harris Road and Stine Road; Thence Westerly along the centerline of Harris Road North 89002'33" West, a dis- tance of 267.76 feet; Thence along a bearing of West, a distance of 45.00 True Point of Beginning; South 00057'27" feet, to the Thence along a nontangent curve concave to the Northwest, having a radius of 1,025.00 feet, through a central angle of 22036'36", an arc distance of 404.49 feet, to the beginning of a reverse curve concave to the Southeast having a radius of 365.00 feet, through a central angle of 23°21'14", an arc distance of 258.83 feet; Thence along a bearing of South 16013'25" West, a distance of 283.28 feet; Thence along a tangent curve concave to the Northwest, having a radius of 385.00 feet, through a central angle of 35041'22", an arc distance of 239.82 feet; Thence along a bearing of South 51054'47" West, a distance of 65.43 feet; Thence along a tangent curve concave to the Southeast, having a radius of 285.00 feet, through a cental angle of 47055'49", an arc distance of 238.42 feet; Thence along a bearing of South 03058'57" West, a distance of 604.13 feet; Thence along a tangent curve concave to the Northwest, having a radius of 855.00 feet, through a cental angle of 35001'44", an arc distance of 522.72 feet, to a point on the North right-of-way line of the Arvin Edison Canal; Thence along said right-of-way North 75°54'23" East, a distance of 99.01 feet; Thence along a tangent curve concave to the Southwest, having a radius of 330.00 feet, through a central angle of 72°43'26", an arc distance of 418.86 feet; Thence along a bearing of South 31°22'11" East, a distance of 49.09 feet; Thence along a bearing of South 89005'33" East, a distance of 594.77 feet; Thence along a tangent curve concave to the Northwest, having a radius of 20.00 feet, through a central angle of 90017'48", an arc distance of 31.52 feet; Thence along a bearing of North 00°36'39" East, a distance of 2,507.26 feet; Thence along a tangent curve concave to the Southwest, having a radius of 20.00 feet, through a central angle of 89°39'12", an arc distance of 31.30 feet; Thence along a bearing of North 89002'33" West, a distance of 193.15 feet to the True Point of Beginning. EXCEPTING the right-of-way for the Farmers Canal. Said Parcel contains 42.5 Acres. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. .......... o0o ...........
