HomeMy WebLinkAboutORD NO 2948ORDINANCE NO. 2948 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED APPROXI- MATELY 2/3 MILE EAST OF FAIRFA~ ROAD, 1/2 MILE NORTH OF PANORAMA DRIVE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield located approximately 2/3 mile east of Fairfax Road, 1/2 mile north of Panorama Drive; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject properties from an R-1 (One Family Dwelling) to an R-2 (Limited Multiple Family Dwelling) or more restrictive Zone, subject to a condition accepted by the property owner and satisfied within the ten (10) day period specified in Section 17.08.190 C. of the Bakersfield Municipal Code, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said properties that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that the proposed zoning is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, ~nd a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of Code of the City of Bakersfield be and the same by changing the land use zoning of certain properties City, the boundaries of which properties are shown on hereto attached and made a part hereof, as follows: the Municipal is hereby amended in said the map FROM AN R-1 (ONE FAMILY DWELLING) ZONE TO AN R-2 (LIMITED MULTIPLE FAMILY DWELLING) OR MORE RESTRICTIVE ZONE: Being a portion of the Northeast one- quarter of the Northwest one-quarter of Section 13, Township 29 South, Range 28 East, M.D.B.&M., City of Bakersfield, County of Kern, State of California, more particularly described as follows: Beginning at the Northeast corner of the Northwest quarter of said Section 13; Thence South 00° 01' 53" East along the North/South Mid-section line of said Sec- tion 13, 816.17 feet, more or less; Thence South 89° 42' 34" West, 1316.50 feet, more or less; Thence North 00° 17' 26" West, 1275.00 feet; Thence South 89° 42' 34" West, 230.00 feet; Thence North 35° 33' 47" West, 100.44 feet; Thence North 00° 17' 26" West, 459.16 feet, more or less to a point on the North line of said Section 13; Thence North 89° 42' 34" East along the North line of said Section 13, 608.19 feet, more or less to the Point of Beginning. Containing 9.49 Acres, more or less. This zone change action and the resulting R-2 (Limited Multiple Family Dwelling) zoning is subject to the following limita- tion: Not more than 31 dwelling units (cumulative) may be built on Lots 1 through 6 (east tier) of Tentative Tract No. 4406. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. .......... o0o ..........
