AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTIONS 10.76.030,
10.76.050, 10.76.070, AND 10.76.080 AND
REPEALING SECTION 10.76.060, RELATING TO
PARADES.
BE IT ORDAINED by the Council of

SECTION 1.
10.76.030 of the Bakersfield Municipal Code
read as follows:

10.76.030 Permit - Application - Filing.
A. Any person desiring to conduct or manage a parade
shall, not less than 48 hours and not more than 90 days before
the proposed parade, apply to the traffic authority for a permit.
B. If such parade is on behalf of an organization
other than the applicant, the applicant shall, with the applica-
tion for permit, file a written consent from such organization
authorizing the application.
SECTION 2.
Section 10.76.050 of the Bakersfield Municipal Code is
hereby amended to read as follows:
10.76.050 Permit - Application - Time for consideration.
The traffic authority shall, not later than 24 hours
before the start of the proposed parade, if such parade is to be
held within 8 days of the filing of the application for permit
and not later than 8 days after filing such application if the
parade is to be held 9 or more days after filing such application,
issue or deny the parade permit. Denial of a permit shall be
accompanied by statement of the basis for denial.
SECTION 3.
Section 10.76.070 of the Bakersfield Municipal Code is
hereby amended to read as follows:

B. An applicant whose application for a parade permit
is denied may appeal to the City Council by filing a written
appeal with the City Clerk who shall set the matter for hearing
by the City Council at its next meeting. The City Council's
decision on the appeal shall be rendered at the close of such
hearing and shall be final. Should the City Council deny the
appeal, it shall set forth its basis for doing so.
SECTION 4.
Section 10.76.080 of the Bakersfield Municipal Code is
hereby amended to read as follows:
10.76.080 Permit Issuance.
A. No permit shall be issued authorizing the conduct
of a parade which the traffic authority finds is proposed to be
held for the sole purpose of advertising any commercial products,
goods, wares, or merchandise.
B. The traffic authority shall issue the permit if,
after consulting with the city manager and appropriate department
heads, he finds that:
1. The conduct of such parade will not significantly
interrupt the safe and orderly traffic movement;
2. The conduct of such parade will not require so
great a number of police officers of the city to properly police
the line of movement and the areas contiguous thereto, as to
prevent normal police protection to the city;
3. The conduct of such parade will not significantly
interfere with the movement of firefighting equipment on route to
a fire;
4. The congestion of persons, animals, and vehicles
at assembly points of the parade will not significantly interfere
with proper fire and police protection of, or ambulance service
to, areas contiguous to such assembly areas.
SECTION 5.
Section 10.76.060 is hereby repealed.
SECTION 6.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
