HomeMy WebLinkAboutORD NO 2943EMERGENCY ORDINANCE NO. 2~ NEW SERIES AN EMERGENCY ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD ADDING SUBSECTION C TO SECTION 17.69.070 OF THE BAKERSFIELD MUNICIPAL CODE RELATING TO EXCEPTIONS TO REOUIREMENTS OF SECTIONS 17.69.030 AND 17.69.040 A. OF THE BAKERSFIELD MUNICIPAL CODE (ADULT ENTERTAINMENT ESTABLISHMENTS). October 29, use permits application WHEREAS, Section 17.69.050 requires all adult entertain- ment establishments not in compliance with the zone district and separation requirements of Sections 17.69.030 and 17.69.040 A. to relocate to sites in compliance with those sections on or before 1984, unless such businesses have obtained conditional as provided in Section 17.69.050 A. or have made for exceptions as provided in Section 17.69.070; and WHEREAS, the City Planning Director has received the first of what may be several Section 17.69.070; and WHEREAS, to insure applications for exceptions under uniformity of treatment of all who apply for such exceptions and to clarify the Council's intent that any exception be for a specified and limited duration, subject to renewal, it is necessary that this ordinance become effective as close as possible to October 29, 1984; and WHEREAS, for the reasons stated above, this Council finds that this ordinance is an emergency ordinance as defined Section 24 of the Charter of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Subsection C. is hereby added to Section 17.69.070 of the Bakersfield ~upicipal Code to read as follows: 17.69.070 Exceptions. C. Each exception granted under the provisions of this Section and each renewal thereof after the date of its approval. for each renewal of an exception shall expire one year from and An application shall be filed and the content of such applica- tion and the procedures for processing it shall be the same as prescribed herein for application for an initial exception. No fees shall be charged for filing an application for renewal or for an appeal from a decision thereon. SECTION 2. This ordinance is declared to be an emergency ordinance for the immediate preservation of the public health, peace, property, safety and general welfare and shall become effective immediately upon its passage. .......... o0o ..........
