AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF BAKERSFIELD, CALIFORNIA, APPROVING A FORMAL
AGREEMENT RELATING TO A PUBLIC LEASEBACK BY
AND BETWEEN THE CITY OF BAKERSFIELD AND THE
CITY OF BAKERSFIELD PUBLIC FACILITIES CORPORATION
THE CITY COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA DOES ORDAIN
AS FOLLOWS:
SECTION 1. The agreement by and between the City of Bakersfield
and the City of Bakersfield Public Facilities Corporation, which agreement is
a "public leaseback" as that term is defined by Government Code Section 54240(b),
is approved. Three copies of said agreement, entitled "Bakersfield Facilities
Site Lease and Project Lease (Wastewater Treatment Plant 3)" (herein "Agreement"),
are on file with the City Clerk of the City.
SECTION 2. The Mayor is hereby authorized to execute, and the
City Clerk to attest, said Agreement; provided, however, that the "base rent"
required by Section 6 of said Agreement does not exceed the amount specified in
Section 3 hereof.
SECTION 3. The "base rent" required by Section 6 of said Agreement
shall not exceed $2,175,000 annually.
SECTION 4. This ordinance shall be subject to referendum pursuant
to the provisions of the Election Code of the State of California, as the same
relate to referendum.
SECTION 5. This ordinance shall be in full force and effect thirty
(30) days after its passage.
I HEREBY CERTIFY that the foregoing Ordinance was passed and adopted by
the Council of the City of Bakersfield at a regular meeting thereof held on
the 5th day of December , 198~ by the following vote:
