HomeMy WebLinkAboutORD NO 2952ORDINANCE NO. 2952 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.06.020 OF CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD REGARDING PREZONING OF PROPERTY KNOWN AS GARNSEY ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held hearings on a request by the City of Bakersfield to zone certain property now being annexed to said City and made several general and specific find- ings of fact which warranted a negative declaration of environ- mental impact; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from this zoning action; and WHEREAS, the proposed zoning substantially conforms to the General Plan; and WHEREAS, the City Council bas determined after due consideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the Planning Commission hearing, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: A. All the foregoing recitals are found to be true and correct. B. The Negative Declaration for this zoning action is hereby approved and adopted. C. That Section 17.06.020 of Chapter 17.06 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include those certain properties in the County of Kern located contiguous to the boundary of the City of Bakersfield and north of Stockdale Highway in the vicinity of and intersecting with North McDonald Way, North Stine Road, and Garnsey Avenue, known as the GARNSEY ANNEXATION, upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically described as follows: TO PREZONE TO AN R-S (RESIDENTIAL SUB- URBAN) OR MORE RESTRICTIVE ZONE: Beginning at the Northwest corner of Parcel Map 2915 recorded April 21, 1975 in Parcel Map Book 13 at Page 106 in the Office of the Kern County Recorder; Thence (1) Northerly along the Northerly extension of the West line of said Parcel Map 2915 and along the West line of Tract 1573 recorded September 27, 1950 in Map Book 7 at Page 119 in the Office of the Kern County Recorder, and the West line of Tract 1892 recorded June 27, 1956 in Map Book 9 at Page 78 in the Office of the Kern County Recorder, and the Northerly extension thereof to intersect the South line of Garnsey Lane; Thence (2) Easterly along the last named South line to intersect the Southerly extension of the Easterly line of the West 75 feet of Lot 2 of Tract 1460 recorded September 15, 1948 in Map Book 6 at Page 147 in the Office of the Kern County Recorder; Thence (3) Northerly along the last named East line to intersect the centerline of Garnsey Lane of 60 feet in width; Thence (4) Westerly along the last named centerline to intersect the centerline of the Stine Canal right-of-way of 85 feet in width as said right-of-way and Garnsey Lane are shown on Map of Tract 1800 re- corded January 26, 1956 in Map Book 9 at Page 43 in the Office of the Kern County Recorder; Thence (5) Southerly along the last named canal centerline to intersect the Westerly extension of the North line of Tract 2689 recorded May 25, 1962 in Map Book 12 at Page 186 in the Office of the Kern County Recorder; Thence (6) Easterly along the last named North line to intersect the centerline of Garnsey Avenue of 60 feet in width; Thence (7) centerline tension of Map 2915; Southerly along the last named to intersect the Westerly ex- the North line of said Parcel Thence (8) Easterly along the last named North line and Westerly extension thereof to the Point of Beginning. TO PREZONE TO AN R-1 (ONE FAMILY DWELLING) OR MORE RESTRICTIVE ZONE: Beginning at the Southwest corner of Tract 1751 recorded April 12, 1956 in Map Book 9 at Page 63 in the Office of the Kern County Recorder; Thence (1) Northeasterly along the West line and North line of said Tract 1751, and along the North line of Tract 1750 re- corded January 1955 in Map, Book 8 at Page 181 in the Office of the Kern County Re- corder; add the Northwesterly line of Tract 1753 recorded July 14, 1954 in Map Book 8 at Page 139 in the Office of the Kern County Recorder, and the West line of Tract 2483 recorded December 30, 1960 in Map Book 11 at Page 155 in the Office of the Kern County Recorder, and the West line of Tract 1800 recorded January 26, 1956 in Map Book 9 at Page 43 in the Office of the Kern County Recorder to intersect the Southwesterly right-of-way line of County Road No. 2099 as described in that certain deed recorded in Official Records Book 3220 at Page 332 in the Office of the Kern County Recorder; Thence (2) Westerly, Northerly, and Easterly along the South, West, and North lines of said CouDty Road No. 2099 to intersect the West line of said Tract 1800, said inter- section being a point on the North right- of-way line of Chester Lane and the South- east corner of that certain parcel of land described in the deed recorded December 11, 1958 in Official Records Book 3049 at Page 249 in the Office of the Kern County Re- corder; Thence (3) Northerly and Easterly along the West and North lines of the last named parcel of land to intersect the centerline of the Stine Canal; Thence (4) Southerly along the last named centerline to intersect the South right-of- way line of Chester Lane; Thence (5) Easterly along the last named South right-of-way line to intersect the West line of Parcel "B" of Parcel Map 532 recorded September 29, 1972 in Parcel Map Book 3 at Page 180 in the Office of the Kern County Recorder; Thence (6) Southerly along the last named West line to intersect the South line of the last named Parcel "B"; Thence (7) Easterly along the last named South line to intersect the East line of Lot 14 of Tract 1460 recorded September 15, 1948 in Map Book 6 at Page 147 in the Office of the Kern County Recorder; Thence (8) Southerly along the East line of Lots 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24 and 25 of said Tract 1460 to intersect the South line of said Lot 25; Thence (9) Westerly along the last named South line to intersect the East line of the West 75 feet of said Lot 25; Thence (10) Southerly along the Southerly extension of the last named East line to intersect the centerline of Garnsey Lane; Thence (11) Westerly along the last named centerline to intersect the centerline of the Stine Canal as shown on said Tract 1800; Thence (12) Southerly along the last named centerline to intersect the Westerly ex- tension of the North line of Tract 2689 recorded May 25, 1962 in Map Book 12 at Page 186 in the Office of the Kern County Recorder; Thence (13) Easterly along the last named North line to intersect the centerline of Garnsey Avenue; Thence (14) Southerly along the last named centerline to intersect the Easterly ex- tension of the South line of said Tract 2689; Thence (15) Westerly alonql the last named South line and the Westerly extension there- of to intersect the centerline of the Stine Canal; Thence (16) Southerly along the last named centerline to a point which lies 140 feet North of the North right-of-way line of Stockdale Highway as measured along the centerline of said Stine Canal; Thence (17) Westerly along a line parallel to and 140 feet North of the North right-of- way line of Stockdale Highway as measured along the centerline of the Stine Canal to intersect the Westerly right-of-way line of said Stine Canal; Thence (18) Southerly along the last named Westerly right-of-way line to intersect the North right-of-way line of Stockdale Highway; Thence (19) Westerly along the North right-of-way line to the Beginning. last named Point of Excluding therefrom Lots 49 through 53 and Lot 75 of said Tract 1751.
