HomeMy WebLinkAboutORD NO 2970ORDINANCE NO. 297D NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED IN AN AREA COMMONLY KNOWN AS THE LOWELL ADDITION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the city of Bakersfield located in an area commonly known as the Lowell Addition; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject properties from an R-2 (Limited Multiple-Family Dwelling) Zone to an R-1 (One-Family Dwelling), from a C-2 (Commercial) Zone to an R-1 (One-Family Dwelling), and from an R-3 (Limited Multiple-Family Dwelling) Zone to an R-1 (One-Family Dwelling) Zone and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed pro- ject; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said properties, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that the proposed zoning is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain properties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: Section A FROM AN R-2 (LIMITED MULTIPLE-FAMILY DWELLING) ZONE TO AN R-1 (ONE-FAMILY DWELLING), OR MORE RESTRICTIVE ZONE: A parcel of land situated in the City of Bakersfield, County of Kern, State of California, being a portion of Section 31, Township 29 south, Range 28 east, M.D.B.&M., more particularly described as follows: Beginning at the northwest corner of Lot 18, of Block 8 as shown on the map of the Re-Subdivision of Lots 3, 4 and 5 of the California Avenue Park Tract No.. 2 filed October 19, 1925 in Map Book 3 at Page 130 in the office of the Kern County Recorder; Thence easterly along the north line of said Lot 18 and the easterly extension thereoi to intersect the westerly right- of-way line of Pershing Street; Thence southerly along the last named westerly right-of-way line to intersect the northerly right-of-way line of 8th Street; Thence westerly along the last named northerly right-of~way line to intersect the easterly right-of-way line of "T" Street; 2 o Thence northerly along the easterly right-of-way line of Beginning. last named to the Point FROM A C-2 (COMMERCIAL) ZONE TO AN R-1 (ONE-FAMILY DWELLING), OR MORE RESTRICTIVE ZONE: All that portion of the Map of the California Avenue Park Tract No. 2 filed March 30, 1925 in Map Book 3 at Page 115 in the Office of the Kern County Recorder, lying within Section 31, Township 29 south, Range 28 east, M.D.B.&M., more particularly described as follows: The north half of Lot 3 of Block 8 of said California Avenue Park Tract No. 2. Section B FROM AN R-3 (LIMITED MULTIPLE-FAMILY DWELLING) ZONE TO AN R-1 (ONE-FAMILY DWELLING, OR MORE RESTRICTIVE ZONE: All that portion of the Lowell Addition as shown on the Map of the City of Bakersfield filed April 19, 1904 in Map Book 1 at Page 13 in the Office of the Kern County Recorder, and being a portion of Section 31, Township 29 south, Range 28 east, M.D.B.&M., more particularly described as follows: Beginning at the intersection of the centerline of loth Street with the west right-of-way line of "R" Street; Thence southerly along the last named west right-of-way line to intersect the centerline of the Kern Island Canal; Thence southeasterly along the last named centerline to intersect the centerline of the alley within Block 35 of said Lowell Addition; Thence southerly along the last named centerline and the southerly extension thereof to intersect the easterly exten- sion of the south line of Lot 12 of Block 38 of said Lowell Addition; Thence westerly along the last named south line and the westerly extension thereof to intersect the east right-of- way line of "P" Street; Thence northerly along the last named east right-of-way line to intersect the centerline of 10th Street; Thence easterly along the last named centerline to the Point of Beginning. Section C FROM AN R-3 (LIMITED-MULTIPLE FAMILY DWELLING) ZONE TO AN R-1 (ONE-FAMILY DWELLING), OR MORE RESTRICTIVE ZONE: A parcel of land situated in the City of Bakersfield, County of Kern, State of California, being a portion of Section 31, Township 29 south, Range 28 east, M.D.B.&M., more particularly described as follows: Beginning at the intersection of the south line of 4th Street with west line of "P" Street as shown on the Map of Tract No. 1079 recorded September 1, 1933 in Map Book 4 at Page 126 in the Office of the Kern County Recorder; Thence westerly along the last named south line to intersect the east line of "N" Street; Thence southerly along the last named east line to intersect the easterly extension of the south line of the north 147.63 feet of Block N of the Lowell Addition as shown on the Map of the City of Bakersfield filed April 19, 1904 in Map Book 1 at Page 13 in the Office of the Kern County Recorder; Thence westerly along the last named south line to intersect the east line of "L" Street; Thence southerly along the last named east line to intersect the south line of the north 150 feet of Block S of said Lowell Addition; Thence westerly along the last named south line to intersect the west line of the east 152.63 feet of said Block S; Thence southerly along the last named west line to intersect the south line of the north 160.50 feet of said Block S; Thence easterly along the last named south line and the easterly extension thereof to intersect the east line of Street; Thence north along the last named east line, a distance of 55.25 feet; Thence east a distance of 137.6 feet; Thence south a distance of 200 feet; Thence east a distance of 37.65 feet; Thence south a distance of 76 feet; Thence west a distance of 37.53 feet; Thence south a distance of 152 feet; Thence east a distance of 12.28 feet; Thence south a distance of 90.25 feet; Thence east a distance of 20 feet; Thence south a distance of 97.27' feet to a point on the northerly right-of-way line of the Kern Island Canal; Thence northeasterly along the last named northerly right-of~.way line to intersect a line 137.25 feet west of and parallel with the west right-of-way line of "P" Street; Thence north along the last named paral- lel line, a distance of 234 feet more or less to intersect a line 376.57 feet south of and parallel with the south right-of-way line of 2nd Street; Thence west along the last named parallel line, a distance of 15.375 feet to inter- sect a line 152.625 feet west of and par- allel with the west right-of-way line of "P" Street; Thence north along the last named paral- lel line, a distance of 459.07 feet to intersect the north right-of-way line of 2nd Street; Thence west along the last named north line to intersect the west line of Lot 42 of Tract 1103 recorded June 24, 1939 in Map Book 4 at Page 158 in the office of the Kern County Recorder; Thence north along the last named west line to intersect the north line of said Lot 42; Thence east along the north lines of Lots 42, 41, 39, 38, and 37 of said Tract 1103 to intersect the west right-of-way line of "P" Street; Thence north along the last named west line to the Point of Beginning.
