BAKERSFIELD ADDINO CHAPTER 8.60 TO THE
BAKERSFIELD MUNICIPAL CODE ADOPTING BY
PEFERENCE, AS AMENDED, ORDINANCE NO. G-3941
OF THE BOARD OF SUPERVISORS OF THE COUNTY OF
KERN (DIVISION 8 OF PART 3 OF THE ORDINANCE
CODE OF THE COHNTY OF KERN) RELATING TO UNDER-
GROUND STORAGE TANKS CONTAINING HAZARDOUS
SUBSTANCES

SECTION 1.
8.60 is hereby added to the Bakersfield Municipal

CONTAINING HAZARDOUS SUBSTANCES
Adoption of Kern County Ordinance No. G-3941
(Division 8 of Part 3 of the Ordinance Code
of the County of Kern).
Section 3912.6.01 amended.
Section 3912.13.01 amended.
Section 3912.22.01 amended.
Section 3912.23.01 deleted.
8.6(].01(I Adoption of Kern County Ordinance No. Gi-3941
(Division 8 of Part 3 of Ordinance Code of the County of Kern).
Except as otherwise provided in this chapter, that
certain ordinance designate~ as Ordinance No. G-3941 of the Board
of Supervisors of the County of Kern (and codified as Division 8
of Part 3 of the Ordinance Code of the County of Kern) is hereby
adopted by reference and shall be applicable to underground stor-
age tanks containing hazardous substances in the C~ty.
8.60.020 Section 3q12.6.01 amended.
That portion of the aforesaid Ordinance No. G-3941 set
forth as Section 3912.6.01 of the Ordinance Code of the County of
Kern is, as adopted by reference, amended to read as follows:
"No person shall operate a facility for the
underground storage of any hazardous substance
unless by authority of a valid, unexpired and
unrevoked Permit to Operate issued to the owner
pursuant to the provisions of Chapters 3 or 4."
8.60.030 Section 3912.13.01 amended.
That portion of the aforesaid Ordinance No.

8.60.040 Section 3912.22.01 amended.
That portion of the aforesaid Ordinance No. 3941 set
forth as Section 3912.22.01 of the Ordinance Code of the County
of Kern is, as adopted by reference, amended to read as follows:
"The degree of protection required by this
Division is considered reasonable for regula-
tory purposes. The standards set forth herein
are minimal standards and this Division does
not imply that compliance will ensure that there
will be no unauthorized discharge of hazardous
material. This Chapter shall not create lia-
bility on the part of Kern County, the City of
Bakersfield, any officer or employee thereof
for damages that result from reliance on this
Division or any administrative dec,sion law-
fully made thereunder. All pesons handling,
storinq, using, processing and disposing of
hazardous materials within Kern County and the
Citv of Bakersfield should be and are advised
to determine to their own satisfaction the level
of protection iD addition to that required by
this Division necessary or desirable to ensure
that there is no unauthorized discharge of
hazardous materials."
8.60.050 Section 3912.23.01 deleted.
That portion of the aforesaid Ordinance

This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
