HomeMy WebLinkAboutORD NO 2963ORDINANCE NO. 2963 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.06.020 OF CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD REGARDING PREZONING OF PROPERTY KNOWN AS PANAMA NO. 5 ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held hearings on a request by the City of Bakersfield to zone certain property now being annexed to said City; and WHEREAS, the Council declared that it has reviewed, has this date by separate action evaluated and considered the information contained in the Final EIR for this project, made findings, and certified that final EIR as complete in compliance with the California Environmental Ouality Act, the State EIR Guidelines, and City Resolution No. [32-83; and WHEREAS, the proposed zoning substantially conforms to the General Plan; and WHEREAS, the City Council has determined after due consideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the Planning Commission hearing, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council. of the City of Bakersfield as follows: A. All the foregoing recitals are found to be true and correct. Map) of same is B. That Section 17.06.020 of Chapter 17.06 the ~unicipal Code of the City of 5akersfield, (Zoning be and the hereby amended by extending the boundaries of said map to include those certain properties in the County of Kern located contiguous to the boundary of the City of Bakersfield and north of Panama Lane to the Southern Pacific Railroad, east of Gosford Road to the Arvin-Edison Canal, known as the PANAMA NO. 5 ANNEXA- TION, upon the annexation of said property the boundaries of which property are shown attached and made a part of this ordinance, described as follows: to the City of Bakersfield, on the map hereto and are more specifically TO AN A (AGRICULTURE) OR MORE RESTRICTIVE ZONE: Commencing at Southeast corner of Section 21, said point also being the "True Point of Beginning"; Thence N 89° 36' 33" W, on and along the South line of Section 21, a distance of 5,276.40 feet, to the Southwest corner of said section; Thence N 00° 00' 07" W, on and along the West line of said section, a distance of 4,665.00 feet; Thence N 89° 59' 53" E, 56.11 feet, to the beginning of a non-tangent curve, concave Northeasterly, having a radius of 5,280 feet (one mile), from which point the radial point of said curve bears N 82© 31' 41" E; Thence Southeasterly, on and along said curve, through a central angle of 82° 22' 13", an arc distance of 7,590.70 feet, to a point on the West line of Section 22; Thence S 89° 27' 22" E, 1,157.04 feet, to a point on the Westerly right-of-way line of the Arvin-Edison Canal and the beginning of a non-tangent curve, concave Northeasterly, having a radius of 305.00 feet, from which point the radial point of said curve bears N 40° 55' 27" E; Thence Southeasterly, on and along said curve and right-of-way, through a central angle of 35° 41' 14", an arc distance of 189.97 feet; Thence S 00° 06' 08" W, 29.45 feet, to a point on the South line of Section 22; Thence N 89° 44' 16" W, on and along said section line, a distance of 1,329.20 feet, to the Southeast corner of Section 21 and the "True Point of Beginning". Containing 152.14 acres. EXCEPTING THEREFROM that portion within road right-of-way. TO AN R-1 (ONE-FAMILY DWELLING) OR MORE RESTRICTIVE ZONE: Commencing at the Southeast corner of Section 21; Thence N 00° 09' 27" E, on and along the East line of Section 21, a distance of 107.62 feet, to the "True Point of Beginning", and the beginning of a non- tangent curve, concave to the Northeast, having a radius of 5,280 feet (one mile), from which point the radial point of said curve bears N 00° 09' 28" E; Thence Northwesterly, on and along said curve, through a central angle of 82° 22' 13", an arc distance of 7,590.70 feet; Thence N 89° 59' 53" E, 1,213.89 feet; Thence N 00° 12' 03" E, 600.61 feet, to a point on the South right-of-way line of Sunset R.R.; Thence $ 89° 48' 16" E, on and along said right-of-way line, a distance of 2,369.23 feet, to a point on the Westerly right- of-way line of the Arvin-Edison Canal; Thence Southeasterly on and along said right-of-way line the following courses (1) S 15° 43' 10" E, 78.74 feet, to the beginning of a tangent curve, concave Northeasterly, having a radius of 305.00 feet; Thence (2) Southwesterly, on and along said curve, through a central angle of 18", an arc distance of 218.37 41° 01' feet; Thence to the (3) S 56° 44' 28" E, 405.44 feet, beginning of a tangent curve, con- cave Southwesterly, having a radius of 745.00 feet; Thence (4) Southeasterly, on and along said curve, through a central angle of 32° 17' 39", an arc distance of 419.91 feet; Thence (5) S 24° 26' 49" E, 2,140.46 feet, to a point on the East line of Section 21; Thence S 00° 09' 27" W, on and along said East line, a distance of 2,452.18 feet, to the "True Point of Beginning". Containing 430.626 acres. EXCEPTING THEREFROM that portion within road right-of-way. TO AN R-2 (LIMITED MULTIPLE FAMILY DWELLING) OR MORE RESTRICTED ZONE: Commencing at the Southwest corner of Section 22; Thence N 00° 09' 27" E, on and along the West line of Section 22, a distance of 107.62 feet, to the "True Point of Beginning"; Thence continuing, N 00° 09' 27" E, 2,452.18 feet, to a point on the Westerly right-of-way line of the Arvin-Edison Canal; Thence Southeasterly, on and along said right-of-way line the following courses (1) S 24° 26' 49" E, 2,069.54 feet; Thence (2) S 65° 33' 11" W, 15.00 feet; Thence (3) S 24° 26' 49" E, 450.00 feet; Thence (4) N 65° 33' 11" E, 15.00 feet; Thence (5) S 24° 26' 49" E, 71.70 feet, to the beginning of_ a tangent curve, con- cave Northeasterly, having a radium of 305.00 feet; Thence (6) Southeasterly, on and along said curve, through a central angle of 24° 37' 44", an arc distance of 131.11 feet; Thence N 89° 27' 22" W, 1,157.04 feet, to a point on the West line of Section 22 and the "True Point of Beginning". Containing 31.572 acres. EXCEPTING THEREFROM that portion within road right-of-way.
