HomeMy WebLinkAboutORD NO 2962ORDINANCE NO. 2962 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.06.020 OF CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD REGARDING PREZONING OF PROPERTY KNOWN AS BUENA VISTA NO. 2 ANNEXATION. WHEREAS, in accordance with the procedure set: forth in the provisions of Title 17 of the ~4unicipal Code of the City of Bakersfie]d, the Planning Commission held bearings on a request by the City of Bakersfield to zone certain property now being annexed to said City; and WHEREAS, the Council has this date by separate action declared that it has reviewed, evaluated and considered the information contained in the Final EIR for this project, made findings, and certified that final EIR as complete in compliance with the California Environmental duality Act, the State EIR Guidelines, and City Resolution No. 132-83; and WHEREAS, the proposed zoning substantially conforms to the General Plan; and WHEREAS, the City Council has determined after due consideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the Planning Commission hearing, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of ~akersfield as follows: A. All the forego}n9 recitals are found to be true and correct. a. That Section 17.06.020 of Chapter 17.06 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extendinq the boundaries of said map to include those certain properties in the County of Kern located contiguous to the boundary of the City of Bakersfield and south of Stockdale Highway, west of Buena Vista Road, known as the BUENA VISTA NO. 2 ANNEXATION, upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically describe~ as follows: TO A C-O (COMMERCIAL AND PROFESSIONAL OFFICE) OR MORE RESTRICTIVE ZONE: Commencing at the Northeast corner of Section 1, Township 30 South, Range 26 East, M.D.B.&M.,; Thence S 00050'50" W, on and along the East line of said section, a distance of 1,238.428 feet, to a point on the North right-of-way line of Stock dale Highway and the "True Point of Beginning;" Thence Westerly, on and along said right-of-way line, the following two courses: (1) S 71058'45" W, 162.130 feet, to the beginning of a tangent curve, concave northerly, having a radius of 870.00 feet; Thence (2) Westerly, on and along said curve, through a central angle of 43040'45", an arc distance of 663.241 feet; Thence S 39025'37" W, 110.00 feet; Thence S 50o34'23" E, 449.389 feet, to the beginning of a tangent curve, concave to the Northeast, having a radius of 2,055.00 feet; Thence Southeasterly, on and along said curve, through a central anqle of t6°44'36", an arc distance of 600.530 feet, to a point on the East line of Section 1; Thence N 00050'50" E, on and along said East line, a distance of 686.186 feet, to the "True Point of Beginning." 7.1 acres (more or less).
