HomeMy WebLinkAboutORD NO 2983ORDINANCE NO. 2983 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.06.020 OF CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD REGARDING PREZONING OF PROPERTY KNOWN AS HUGHES NO. 2 ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held hearings on a request by the City of Bakersfield to zone certain property now being annexed to said City and made several general and specific find- ings of fact which warranted a negative declaration of environ- mental impact; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from this zoning action; and WHEREAS, the proposed zoning substantially conforms to the General Plan; and WHEREAS, the City Council has determined, after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the Planning Co~nission hearing, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: A. All the foregoing recitals are found to be true and correct. B. The Negative Declaration for this zoning action is hereby approved and adopted. C. That Section 17.06.020 of Chapter 17.06 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include those certain properties in the County of Kern located contiguous to the boundary of the City of Bakersfield and at the southeast corner of Freeway 99 and Pacheco Road, known as the ~UGHES NO. 2 ANNEXATION, upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordi- nance, and are more specifically described as follows: TO AN R-1 (ONE-FAMILY DWELLING) OR MORE RESTRICTIVE ZONE: A parcel of land situated in the County of Kern, State of California, being a portion of Section 24, Township 30 South, Range 27 East, M.D.B.&M., more par- ticularly described as follows: Beginning at the intersection of the south line of the north 45 feet of said Section 24, with the west line of the east 45 feet of the northwest quarter of said Section 24, said intersection being a point on the existing Corporate Boundary of the City of Bakersfield, and the Point of Beginning for this descrip- tion; Thence (1) Southerly, westerly, northerly and easterly along the last named existing Corporate Boundary to the Point of Beginning. Containing 31.29 acres, more or less. Excluding Lots 13 to 31 of Tract 2499 recorded July 20, 1962, in Map Book 13 at Page 23 in the Office of the Kern County Recorder. Containing 4.66 acres, more or less. Excluding Tract 2500 recorded December 14, 1962, in Map Book 13 at Page 104 in the office of the Kern County Recorder. Containing 7.10 acres, more or less. Excluding Tract 2501 recorded July 20, 1962, in Map book 13 at Page 26 in the Office of the Kern County Recorder. Containing 5.55 acres, more or less. 2 TO AN MH (MOBILEHOME) OR MORE RESTRICTIVE ZONE: Lots 13 to 31 of Tract 2499 recorded July 20, 1962, in Map Book 13 at Page 23 in the Office of the Kern County Recorder. Containing 4.66 acres, more or less. Tract 2500 excluding Lots 1 and 2 recorded December 14, 1962, in Map Book 13 at Page 104 in the Office of the Kern County Recorder. Containing 6.78 acres, more or less. Tract 2501 recorded July 20, 1962, in Map Book 13 at Page 26 in the Office of the Kern County Recorder. Containing 5.55 acres, more or less. TO AN R-1-CH (ONE-FAMILY DWELLING C~URCH) OR MORE RESTRICTIVE ZONE: Lots 1 and 2 of Tract 2500 recorded December 14, 1962, in Map Book 13 at Page 104 in the Office of the Kern County Recorder. Containing 0.32 acres, more or less. This ordinance shall become effective upon the annexa- tion of the above-described territory to the City of Bakersfield. .......... o0o ..........
