NEW SERIES
AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTIONS 17.42.044,
17.42.050 A, 17.42.060 E, AND 2.18.020 B AND
REPEALING SECTION 17.42.060 E OF THE
BAKERSFIELD MUNICIPAL CODE RELATIVE TO
EXCAVATIONS AND REMOVAL OF ROCK, RIVER GRAVEL,
SAND AND OTHER MATERIALS.
BE IT ORDAINED by the Council of the city of Bakersfield
as follows:
SECTION 1.
That Section 17.42.044 of the Bakersfield Municipal Code
is hereby amended to read as follows:
17.42.044 Excavations and removal of rock, river gravel,
sand and other materials shall be subject to California
Reclamation Board permit. Materials removed from city~-owned pro-
perties shall be administered by the Agricultural Water Division
in accordance with Kern River channel maintenance programs.
SECTION 2.
That Section 17.42.050 A of the Bakersfield Municipal
Code is hereby amended to read as follows:
17.42.050 A Pursuant to the provisions of this section,
the building director, referred to hereinafter as the "director"
for purposes of this section, may revoke permits issued under sec-
tions 17.42.040 on the following grounds: Failure of the holder
of the permit to conform to any conditions set forth in Section
17.42.040 within thirty days after mailing of notice of such
failure by the director, or within reasonable time specified by
the director if the failure
the said thirty days.

SECTION 3.
Section 2.18.020 B of the Bakersfield Municipal Code
is hereby
regarding
rates and
amended to read as follows:
2.18.020 B Make recommendations to the City Council
the establishment of municipal and agricultural water
rates for Kern River sand sales by the Council.
SECTION 4.
That Section 17.42.060 E of the Bakersfield Municipal
Code is hereby repealed and Section 17.42.060 F is hereby relet-
tered E.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

and adopted by the Council of the city of Bakersfield at a regu-
