NEW SERIES
AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE
BAKERSFIELD MUNICIPAL CODE BY CHANGING THE
LAND USE ZONING OF THOSE CERTAIN PROPERTIES
IN THE CITY OF BAKERSFIELD LOCATED SOUTH OF
DENISE AVENUE AND THE EASTERLY EXTENSION OF
DENISE AVENUE AND NORTHWESTERLY OF THE
CARRIER CANAL.
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the City of
Bakersfield, the Planning Commission has held a public hearing on
a petition to change the land use zoning of those certain properties
in the City of Bakersfield located south of Denise Avenue and the
easterly extension of Denise Avenue and northwesterly of the
Carrier Canal; and
WHEREAS, the Planning Commission, as a result of said
hearing, did make several general and specific findings of fact
which warranted a negative declaration of environmental impact
and a change of zoning of the subject properties from an
R-S-2-1/2-A-FP-S (Residential Suburban Two and One-Half Acre
Floodplain Secondary) Zone to an R-S-1-A-FP-S (Residential
Suburban One-Acre Floodplain Secondary) Zone, and the Council has
considered said findings and all appear to be true and correct;
and
WHEREAS, there appears to be no substantial detrimental
environmental impact which could result from the proposed project;
and
WHEREAS,

the City Council has determined after due con-
petition and the recommendations of the Plan-
ning Commission herein on file, together with the reasons advanced
at the hearing for a change of zoning of said properties that a
zoning change should be authorized; and
WHEREAS, the City Council has determined and found that
the proposed zoning is consistent with the General Plan of the
City of Bakersfield.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
1. All of the foregoing recitals are hereby found to
be true and correct.
2. An environmental assessment was made of the project,
and a Negative Declaration was adopted by the Planning Commission
after a public hearing thereon, and this Council hereby approves
and adopts the Negative Declaration.
3. Section 17.06.020 (Zoning Map) of the Municipal
Code of the City of Bakersfield be and the same is hereby amended
by changing the land use zoning of certain properties in said
City, the boundaries of which properties are shown on the map
hereto attached and made a part hereof, as follows:
FROM AN R-S-2-1/2-A-FP-S (RESIDENTIAL
SUBURBAN TWO AND ONE-HALF ACRE FLOODPLAIN
SECONDARY) ZONE TO AN R-S-1-A-FP-S (RESI-
DENTIAL SUBURBAN ONE-ACRE FLOODPLAIN
SECONDARY), OR MORE RESTRICTIVE ZONE:
PARCEL 1: The easterly 74.30 feet of
Parcel 3 of Parcel Map No. 2565,
recorded February 19, 1975, Book 22,
Page 188 of Parcel Maps, in the Office
the County Recorder of said County.

PARCEL 2: That portion of the northwest
Quarter of the southwest Quarter of
Section 17, Township 29 South, Range 28
East, M.D.B.&M., described as follows:
Beginninq at the northwest corner of said
northwest Quarter of the southwest Quarter
of Section 17;
Thence along the north line of said north-
west Quarter, South 88055'49" East, 642.72
feet to the intersection with the canal
right-of-way line as described in deed
recorded in Book 4177, Page 195 Official
Records;
Thence along said right-of-way line and deed
line, South 54025'25" West, 456.38 feet;
Thence South 63010'35" West, 295.88 feet to
the westerly line of the northwest Quarter
of the southwest Quarter of Section 17;
Thence along said westerly line, North
01°01'36" West, 411.10 feet to the Point of
Beginning.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

I HEREBY CERTIFY that the foregoing Ordinance was passed
