AN EMERGENCY ORDINANCE OF THE COUNCIL OF THE
CITY OF BAKERSFIELD ADDING SECTION 17.08.025
TO THE BAKERSFIELD MUNICIPAL CODE EXEMPTING
FROM ZONING REGULATION TEMPORARY FLARING
DEVICES FOR METHANE GAS.
WHEREAS, a methane gas migration detection and recovery
program is being conducted at the Bakersfield Landfill; and
WHEREAS, in the course of such program, identification
of the location of methane gas requires, for purposes of public
safety, the immediate flaring of that portion of such gas which
cannot feasibly be recovered; and
WHEREAS, the temporary need to deal immediately with
newly discovered methane gas to prevent a hazard to public health
and safety does not allow time to process a conditional use
permit for use of a flaring device, and this emergency ordinance
is necessary for the immediate preservation of the public health
and safety.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
SECTION 1.
Section 17.08.025 is hereby added to the Bakersfield
Municipal Code to read as follows:
17.08.025 Exemption for temporary flaring devices for
methane gas.
Any methane gas flaring device used in connection with
any methane gas migration detection and recovery program is
exempt from the provisions of this title for a period not to
exceed one year from the initial date of such use; thereafter,
such use may continue
permit therefor.

SECTION 2.
This Emergency Ordinance is necessary for the immediate
preservation of the public health and safety and shall ]become
effective immediately upon its passage.
