HomeMy WebLinkAboutORD NO 2878ORDINANCE NO. __g~l~ ____ NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED ON THE EAST SIDE OF STINE ROAD, 800 FEET SOUTH OF HARRIS ROAD. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bake£sfield located on the east side of Stine Road, 800 feet south of Harris Road, and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which wa£ranted a negative declaration of environmental impact and a change of zoning of the subject properties from an A (Agricultural) Zone to an R-1 (One Family Dwelling), or more restrictive zone, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said p£ope£ties that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that the proposed zoning is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: be true and 2. All of the foregoing recitals are hereby found to correct. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of Code of the City of Bakersfield be and the same by changing the land use zoning of certain properties City, the boundaries of which properties are shown on hereto attached and made a part hereof, as follows: the Municipal is hereby amended in said the map FROM AN A (AGRICULTURAL) ZONE TO AN R-1 (ONCE FAMILY DWELLING), OR MORE RESTRICTIVE ZONE: That portion of the southwest 1/4 of Section 23, Township 30 South, Range 27 East, M.D.B.M., in the City of Bakersfield, County of Kern, State of California accord- ing to the Official Plat of said land, approved by the Surveyor General June 1, 1855, described as follows: Beginning at the southwest corne£ of the North 1/2 of the southwest 1/4 of said Section; Thence South 89°43'10" East, along the South line of the North 1/2 of the southwest 1/4, a distance of 569.999 feet; Thence No£th 0°01'18" East, a distance of 528.329 feet; Thence North 89°43'10" West, a distance of 570.00 feet to the West line of Section 23; Thence South 0°01'18" East, along said Section line, a distance of 528.565 feet to the Point of Beginning. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. .......... o0o ..........
