HomeMy WebLinkAboutORD NO 2852ORDINANCE NO. 2852 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD COMMONLY KNOWN AS; 4124 AND 4130 ARDMORE AVENUE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those in the City of Bakersfield commonly known as 4124 Avenue; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject properties from R-3 (Limited Multiple Family Dwelling) Zone to C-O (Commercial and Professional Office) or more restrictive zone, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears environmental impact which could and certain properties and 4130 Ardmore WHEREAS, sideration of said ning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said properties that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that the proposed zoning is consistent with the Genera] Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: the City Council has determined after due con- petition and the recommendations of the Plan- to be no substantial detrimental result from the proposed project; 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of Code of the City of Bakersfield be and the same by changing the land use zoning of certain properties City, the boundaries of which properties are shown on hereto attached and made a part hereof, as follows: the Municipal is hereby amended in said the map FROM AN R-3 (LIMITED MULTIPLE FAMILY DWEL- LING) ZONE TO A C-O (COMMERCIAL AND PROFES- SIONAL OFFICE) OR MORE RESTRICTIVE ZONE: The North 150.00 feet of the East 375.00 feet of Tract 4341 in the City of Bakers- field, County of Kern, State of California as per Map recorded April 29, 1981, Book 30, Pages 193 and 194 in the Office of the County Recorder. EXCEPTING THEREFROM the East 100.5 feet thereof and the right-of-way of Ardmore Ave nue. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and sfter the date of its passage. .......... 000 ..........
