NEW SERIES
AN ORDINANCE OF THE COUNCIL OF THE CITY OF
RAKERSFIELD ADDING SECTION 12.44.035 TO CHAPTER
12.44 OF THE BAKERSFIELD MUNICIPAL CODE RELATIVE
TO EXEMPTION OF FOOD VENDORS OPERATING PUSHCART.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Section 12.44.035 is hereby added to the Bakersfield
Municipal Code to read as follows:
12.44.035 Exemption.
The provisions of this chapter shall not apF~ly to any
food vendor operating a pushcart on a sidewalk with the written
permission of the owner, tenant, or person in possession of the
premises in front of which the food is sold. This section is
declared to be a statement of existing law relative to such
food vendors, rather than an amendment thereof.
SECTION 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
