AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTIONS 5.44.120 AND
5.44.130 OF THE BAKERSFIELD MUNICIPAL CODE
RELATIVE TO PUBLIC DANCES AND TEENAGE
CENTERS.
BE
as follows:
IT ORDAINED by the Council of the City of Bakersfield
SECTION 1.
Section 5.44.120 of the Bakersfield Municipal Code is
hereby amended to read as follows:
A. It is unlawful to permit any person who has not
reached the age of fourteen years to attend or remain at any public
dance unless such person is accompanied by the parent or legal
guardian of such person.
B. It is unlawful for any person to represent himself
or herself to have reached the age of fourteen years in order to
attend or remain at any public dance when such person in fact is
under fourteen years of age, and it is unlawful for any person to
falsely represent himself or herself to be a parent or legal
guardian of any person in order that such person may attend or
remain at any public dance.
C. The fact that a person under the age of fourteen years
secured admission to any such dancehall under false representations
as to age, or false representations that he or she was accompanied
by a parent or guardian, shall be no defense to the person holding
such person in prosecution for violation of this chapter nor that
such person was admitted by an employee.
SECTION 2.
Section 5.44.130 of the Bakersfield Municipal Code is
to read as follows:
Teenage centers Inapplicability of Section

5.44.120.
Section 5.44.120 shall be inapplicable to any public
dance at any teenage center. For purposes of this section,
"teenage center" means a facility operated by a non-profit,
charitable, philanthropic, social service, benevolent, educa-
tional, civic, or religious organization providing recreation and
related activities to persons not less than thirteen (13 nor
more than nineteen (19) years of age.
SECTION 3.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
