HomeMy WebLinkAboutORD NO 2835ORDINANCE NO. 2835 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD ADDING SECTION 3.20.125 TO THE BAKERSFIELD MUNICIPAL CODE REGARDING SALE OF SURPLUS REAL PROPERTY. BE IT ©RDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Section 3.20.125 is hereby added to Title 3 of the Bakersfield Municipal Code and shall read as follows: 3.20.125 Sale of surplus real property. When it is found by the City Manager that the City owns real property which is no longer needed by the City (except for property held in public trust), he shall report the property description and any other pertinent information to the City Council which may authorize the sale thereof by the Finance Operations Manager and the proceeds from any such sale shall be deposited in the City treasury. Such sale shall be conducted either by competitive bids or by negotiated sale in the following manner: A. Competitive bids--The Finance Operations Manager shall obtain an appraisal on the real property to be sold, when such property exceeds $2,500 in value, and shall advertise for competitive and formal bids with a minimum bid of no less than ten percent (10%) below the appraised value. If the property is valued at less than $2,500, then the Finance Operations Manager may accept informal bids. The highest bid shall be accepted for sale. At the time and place of such sale, oral bids may be con- sidered by the Finance Operations Manager after giving proper notice of such fact, provided five percent (5%) higher than the time of opening of bids. such oral bids shall be at least the highest written bid received at The Finance Operations Manager may, at his discretion, require cash or cashier's check in an amount equal to ten percent (10%) of the bid price to be deposited by the bidder at the time of making or submitting his bid. The person to whom any bid is awarded shall consummate the sale and purchase within fifteen (15) days from then, excluding the day of the award of such bid, unless otherwise provided by the Finance Operations Manager. B. Negotiated sale--The City Council may authorize a negotiated sale of real property when it finds that such sale is in the best interests of the City. Such sale, which may be made below the appraised value, shall be subject to the following procedure: 1. An advertised public hearing shall be conducted by the City Council on the proposed sale. The hearing shall consider the issues of whether the proposed sale is in the best interests of the City and whether the benefits to be derived by the City justify the sale price. 2. After a public hearing and before the proposed sale, the City Council must find that the benefits to the City justify the sale to the proposed purchaser at the sale price determined appropriate by the City Council.
