HomeMy WebLinkAboutORD NO 2832ORDINANCE NO. 2832 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.37.060 OF THE BAKERSFIELD MUNICIPAL CODE RELATIVE TO BUILDING HEIGHT LIMITATIONS, FRONT, SIDE AND REAR YARD, MINIMUM LOT AREA AND DISTANCE BETWEEN BUILDINGS IN OS (OPEN SPACE) ZONES. WHEREAS, the Council of the City of Bakersfield referred the matter of building height limits and associated regulations to the Planning Commission for hearing and recommendation; and WHEREAS, a duly noticed public hearing was opened by the Planning Commission to consider this matter on December 16, 1982 and continued to January 6, 1983; and WHEREAS, the Planning Commission considered a Negative Declaration prepared for use in reviewing these proposed amendments; and certified the Negative Declaration as adequate for review of such amendments, and the Council hereby adopts said Negative Declara- tion; and WHEREAS, the Planning Commission found the proposed amend- ments to be consistent with the purpose and intent of the Zoning the General Plan and this Council concurs in such Ordinance and finding. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Section 17.37.060 of the Bakersfield Municipal Code is hereby amended to read as follows: 17.37.060 Building height, front yard, side yard, rear yard, minimum lot area, distance between buildings on the same lot. Building height limitations, front, side and rear yard, minimum lot area and distances between buildings on the same lot restrictions shall be as determined by the Site Plan Review Committee created pursuant to Section 17.53.020 of this Title. That Committee's determination of such regulations shall not be restricted to application of any established City policies or standards but shall further the objectives of insuring compatability of proposed structures with other existing or proposed structures on adjoining parcels and of promoting the public health, safety, welfare and convenience. The decision of the Site Plan Review Committee thereon shall be subject to appeal to the Planning Commission and City Council pursuant to Section 17.53.060 I. of this Title. SECTION 2. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. ......... o0o .........
