HomeMy WebLinkAboutORD NO 2831ORDINANCE NO. 2831 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.26.027 AND ADDING SECTION 17.26.070 OF THE BAKERSFIELD MUNICIPAL CODE RELATIVE TO HEIGHT LIMITATIONS IN THE C-C (CIVIC CENTER) ZONE. WHEREAS, the Council of the City of Bakersfield referred the matter of building height limits to the Planning Commission for hearing and recommendation; and WHEREAS, a duly noticed public hearing was opened by the Planning Commission to consider this matter on December 16, 1982 and continued to January 6, 1983; and WHEREAS, the Planning Commission considered a Negative Declaration prepared for use in reviewing the proposed amendments and certified the Negative declaration as adequate for review of the proposed amendments, and this Council finds tion to be fully adequate and hereby adopts tion; and said Negative Declarar said Negative Declara- WHEREAS, the Planning Commission found the proposed amendments to be consistent with the purpose and intent of the Zoning Ordinance and the General Plan, and this Council concurs in such finding. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Section 17.26.027 of the Bakersfield Municipal Code is hereby amended to read as follows: 17.26.027 Site Plan Review. A. All permitted and conditional uses shall be subject to prior site plan review and approval pursuant to Chapter 17.53. B. The approving authority for all permitted and conditional uses not within the redevelopment area of the City of Bakersfield shall be the Planning Commission of the City of Bakersfield. C. The approving authority for all permitted and conditional uses within the redevelopment area of the City of Bakersfield shall be the Redevelopment Agency. D. The provisions of Chapter 17.53 shall not limit the Planning Commission, City Council or Redevelopment Agency in the exercise of judgement or discretionary review authority otherwise specifically granted to them by City Ordinance. SECTION 2. Section 17.26.070 is hereby added to Bakersfield Municipal Code to read 17.26.070 Building height. Building height shall be of the height of each proposed project the Redevelopment Agency.
