AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE
BAKERSFIELD MUNICIPAL CODE BY ADDING
CHAPTER 17.25 RELATIVE TO AND ESTABLISHING
C-3 (CENTRAL BUSINESS) ZONE REGULATIONS.
WHEREAS,
an amendment to Title
in order to establish
Zone; and
the Council of the City of Bakersfield initiated
17 of the Municipal Code to add Chapter 17.25
regulations for a C-3 (Central Business)
WHEREAS, said proposed amendment was referred to the
Planning Commission for hearing and recommendation; and
WHEREAS, a duly noticed public hearing was opened by
the Planning Commission to consider this matter on December 16,
1982, and continued to January 6, 1983; and
WHEREAS, the Planning Commission considered a Negative
Declaration prepared for use in reviewing these proposed amendments
and certified the Negative Declaration as adequate for review of
the proposed amendment and this Council finds said Negative
Declaration to be fully adequate and adopts the same; and
WHEREAS, the Planning Commission found the proposed
amendments to be consistent with the purpose and intent of the
Zoning Ordinance and the General Plan.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
SECTION 1.
Chapter 17.25 is hereby added to Title 17 of the
Bakersfield Municipal Code to read as follows:

C-3 ZONE

17.25.010 Generally
The regulations set Out in this chapter shall apply in the
C-3 (Central Business) Zone unless otherwise provided in this
title. The zone's intended area of application is generally
between N, H, 20th Streets and Truxtun Avenue. The regulations
pertaining to this zone are to foster the Central Business Zone's
preeminence as the business and cultural center of the Bakersfield
Metropolitan area. It is to promote the establishment and main-
tenance of intensive complementary office, medical, civic and
historic areas which comprise the metropolitan center for commercial,
financial, professional and cultural activities.
17.25.020 Uses permitted
A. The following uses are permitted in a C-3 Zone:

other transit vehicles shall not be stored on site and

B. The accessory buildings or structures necessary to such use

on the same lot or parcel of land.
17.25.035 Site Plan Review
A. All permitted and conditional uses shall be subject to
prior site plan review and approval pursuant to Chapter 17.53.
B. The approving authority for all permitted and conditional
uses not within the redevelopment area of the City of Bakersfield
shall be the Planning Commission of the City of Bakersfield.
C. The approving authority for all permitted and conditional
uses within the redevelopment area of the City of Bakersfield shall
be the Redevelopment Agency of the City of Bakersfield.
D. The provisions of Chapter 17.53 shall not limit the
Planning Commission, City Council or Redevelopment Agency in
the exercise of judgement or discretionary review authority
otherwise specifically granted to them by City Ordinance.
17.25.040 Uses permitted subject to conditional use permit.
Conditional uses specified in Section 17.64.020 may be permitted
subject to conditional use permits
provided for in Chapters 17.64 and
17.25.050 Building height.

Building height shall be unlimited, subject to approval of the
height of each proposed project and component thereof by the
Redevelopment Agency.
17.25.060 Front yard.
Front yard requirements in a C-3 Zone shall be as follows:

comply with the provisions of the R-4 Zone.
17.25.070 Side yards
Side yard requirements in ~ C-3 Zone shall be as follows:
A. Where a lot abuts upon the side of a lot in any R Zone,
there shall be a side yard of not ]ess than five (5) feet. Where
a rear lot line of a reversed corner lot abuts a lot in any R Zone,
the side yard on the street side of the reversed corner lot shall
be not less than fifty percent (50%) of the front yard required on
the key lot.

17.25.080 Rear yard
Rear yard requirements in a C-3 Zone shall be as follows:
A. There shall be behind every building a rear yard having
a minimum depth of ten feet.
B. Where there is an alley at the rear of the lot, such
rear yard shall be measured to the center of the alley.
17.25.090 Minimum lot area.
Minimum lot area in a C-3 Zone shall be as follows: none,
except all buildings used exclusively for dwelling purposes shall
comply with the provisions of the R-4 Zone.
17.25.100 Distance between buildings on the same lot.
Distance requirements between buildings on the same lot in a
C-3 Zone shall be as follows: none, except all buildings used
exclusively for dwelling purposes shall comply with the provisions
of the R-4 Zone.
SECTION 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
