HomeMy WebLinkAboutORD NO 2825ORDINANCE NO. 282~ NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTIONS 1.16.040 A., 1.16.050 C., 1.16.070, 1.16.080, 1.16.090, 1.16.240 A. , 1.16.250 A. , 1.16.250 E. , 1.16.260, 1.16.270 A., 1.16.310, 1.16.330 A., 1.16.340 A., 1.16.350 D., 1.16.360, AND 1.16.370 OF THE BAKERSFIELD MUNICIPAL CODE RELATIVE TO ELECTIONS. BE IT ORDAINED by as follows: Section is hereby amended the Council of the City of Bakersfield SECTION 1. 1.16.040 A. of the Bakersfield Municipal Code to read as follows: 1.16.040 Nominating petition--Time for presenting for nomina- tion and declaration of candidacy--Filing fee. A. A petition for nomination for any one candidate for mayor may be presented to the clerk not earlier than one hundred thirty-five days nor later than one hundred ten days before the date of election. The clerk shall endorse thereon the day, hour and minute when the petition was presented to him and shall not accept any petition after five p.m., on the one hundred tenth day; provided, that if such day is a Saturday, Sunday or other legal holiday, no petition for nomination shall be accepted after five p.m. on the preceding business day. SECTION 2. Section 1.16.050 C. of the Bakersfield Municipal Code is hereby amended to read as follows: 1.16.050 Nominating petition--Examination by city clerk. C. If the petition is insufficient, it may be amended or supplemented by the presentation of additional nominating certificates, not later than ninety-five days before the nominating election. SECTION 3. Section 1.16.070 of the Bakersfield Municipal Code is hereby amended to read as follows: 1.16.070 Resolution calling elections. Not later than ninety days before the day of election, the council shall adopt the resolutions calling the election and requesting consolidation with statewide election. SECTION 4. Section 1.16.080 of the Bakersfield Municipal Code is hereby amended to read as follows: 1.16.080 List of candidates. Immediately after the petitions the city clerk shall in a list and shall, nominating election, for nomination are filed, enter the names of the qualified candidates not later than eighty-two days before the certify such list as being the list of candidates nominated, and the council shall cause said certified list to be filed and published in the proclamation calling the election two times, once a week for two successive weeks, not earlier than the eighty-ninth nor later than the seventy-fifth day before the day of election. SECTION 5. Section 1.16.090 of the Bakersfield Municipal Code is hereby amended to read as follows: 1.16.090 Names on primary ballot. Whenever anyone has declared his candidacy for a primary election, his name shall be printed upon the ballot for the primary election, unless he has died and that fact has been ascertained by the officer charged with the duty of printing the ballot, at least eighty-two days before the day of election. SECTION 6. Section 1.16.240 A. of the Bakersfield Municipal Code is hereby amended to read as follows: 1.16.240 Nominating petition--Time for filing--Filing fee. A. A petition for nomination consisting of not less than twenty-five nor more than fifty individual certificates may be presented to the clerk not earlier than one hundred twenty-four days nor later than ninety-four days before the date set for the special election. The clerk shall endorse thereon the day, hour and minute when the petition was presented to him. SECTION 7. Section 1.16.250 A. of the Bakersfield Municipal Code is hereby amended to read as follows: 1.16.250 Nominating petition--Examination by city Section clerk. A. The examination of petitions of nomination and the correction of said petitions shall be governed by the provisions of the Charter. SECTION 8. Section 1.16.250 E. of the Bakersfield Municipal Code is hereby amended to read as follows: Section 1.16.250 Nominating petition--Examination by city clerk. E. If the petition is insufficient, it may be amended or supplemented by the presentation of an additional nominating petition or petitions containing additional nominating certificates not later than eighty-seven days before the date of the special election. SECTION 9. Section 1.16.260 of the Bakersfield Municipal Code is hereby amended to read as follows: 1.16.26~ List of candidates. The city clerk shall, not later than eighty-two days before the date set for the special election, enter the names of the candidates in a list and shall certify such list as being the list of candidates nominated, and the council shall cause said certified list to be filed and published in the proclamation calling the election two times, once a week for two successive weeks, not earlier than the eighty-ninth day nor later than the seventy-fifth day before the day of the election. SECTION 10. Section 1.16.270 A. of the Bakersfield Municipal Code is hereby amended to read as follows: 1.16.270 Names on ballot and order. A. SECTION 1]. Section 1.16.310 of the Bakersfield Municipal Code is hereby amended to read as follows: Section 1.16.310 Elected councilman. The councilman who has been elected to office pursuant to Sections 1.16.170 through this section shall, after being sworn in, take office on the second regular council meeting followinq the date of the special election. SECTION 12. Section 1.16.330 A. of the Bakersfield Municipal Code is hereby amended to read as follows: 1.16.330 Date of general municiDal election. A. A general municipal election for the election of members of the council shall be held on the first Tuesday after the first Monday in November in each odd-numbered year. SECTION 13. Section 1.16.340 A. of the Bakersfield Municipal Code is hereby amended to read as follows: Nominating petition--Filing fee--Petition in lieu 1.16.340 of filing. A. A petition for nomination, consisting of not less than twenty-five nor more than fifty individual certificates for any one candidate, shall be presented to the city clerk not earlier than the one hundred twenty-fourth day nor later than the ninety- fourth day before the general municipal election. The clerk shall endorse thereon the day, hour and minute when the petition was presented to him. SECTION 14. Section 1.16.350 D. of the Bakersfield Municipal Code is hereby amended to read as follows: 1.16.350 Nominating petition--Examination by city clerk. D. If the petition is insufficient, it may be amended or supplemented by the presentation of an additional nominating petition or petitions containing additional nominating certificates, not later than the eighty-seventh day before the date of the general municipal election. Sect ion hereby amended to SECTION 15. 1.16.360 of the Bakersfield Municipal Code is read as follows: 1.16.360 Withdrawal of candidate for nomination. Any person who has filed his declaration of candidacy, as provided in Sections 1.16.320 through 1.16.410, may, not later than the eighty-second day before the day of the general municipal election, cause his name to be withdrawn from nomination by filing with the clerk an affidavit stating that he so withdraws, and no n~me so withdrawn shall be printed on the ballot. SECTION 16. Section 1.16.370 of the Bakersfield Municipal Code is hereby amended to read as follows: 1.16.370 List of candidates. Immediately after the petitions for nomination are filed, the city clerk shall enter the names of the candidates in a list, with the offices to be filled, whether for a full or unexpired term and the names of the candidates for each, and shall, not later than eighty-two days before the general municipal election, certify such list as being the list of candidates nominated. SECTION 17. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. ......... 000 .........
