ORDINANCE NO. 2820 NEW SERIES
AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 1'7.64.060 OF
THE BAKERSFIELD MUNICIPAL CODE BY AMENDING
SUBSECTION B. AND ADDING SUBSECTION C.
RELATIVE TO WAIVER OF HEARINGS (CONDITIONAL
USE PERMITS AND MODIFICATIONS).

Section
is hereby amended
IT ORDAINED by the Council of the City of Bakersfield
SECTION 1.
17.64.060 B. of the Bakersfield Municipal Code
to read as follows:
17.64.060 Hearing - Fixing time and place and 9ivin9 notice.
B. Waiver of Hearing - Conditional Use Permits. The Board
of Zoning Adjustment may waive public hearing on an application
for conditional use permit for public utility or public service
uses or public buildings when found to be necessary for the
public health, safety, convenience or welfare.
SECTION 2.
Section 17.64.060 C. is hereby added to the Bakersfield
Municipal Code to read as follows:
17.64.060 Hearin9 Fixing time and place and giving notice.
C. Waiver of Hearing Modifications. The Board of Zoning
Adjustment may waive a public hearing on an application for
modification when the application is accompanied by the written
consent to such modification by owners of all property adjacent
thereto or across any street or intersection of streets therefrom.
SECTION 3.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
