HomeMy WebLinkAboutORD NO 2811ORDINANCE NO. 2811 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD COMMONLY KNOWN AS 500 WEST COLUMBUS STREET (CONDITIONAL). WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, commonly known as 500 West Columbus Street; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from MH (Mobile- home) to C-1 (Limited Commercial), and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result and WHEREAS, the City Council sideration of said petition and ning Commission herein on file, at the hearings for a change of zoning of said property, that a zoning change should be authorized, subject to the following condition: from the proposed project; has determined after due con- the recommendations of the Plan- together with the reasons advanced Install a six-foot high chain link fence to City standards along the east property line adjacent to the canal. WHEREAS, the City Council has determined and found that consistent with the General Plan of the this zoning ordinance is BE IT ORDAINED by the Council of the City of Bakersfield. NOW, THEREFORE, City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: FROM AN MH (MOBILEHOME) ZONE TO A C-1 (LIMITED COMMERCIAL) OR MORE RESTRICTIVE ZONE: All that portion in Section 18~ Township 29 South, Range 28 East, M.D.B.&M., described as follows: Beginning at the Northeast corner of Parcel 3 of Parcel Map 3512, City of Bakersfield, County of Kern, State of California as per map recorded September 22, 1976 in Map Book 16, Page 166, Office of the Kern County Recorder; Thence Easterly along the Easterly prolong- ation of the Northerly line of said Parcel 3, 190 feet + to the Easterly line of Parcel 4 of said P~rcel Map 3512; Thence Southeasterly along the Easterly line of said Parcel 4, 460 feet + to the Northerly right-of-way line of West C~lumbus Street; Thence Northwesterly on and along the Northerly right-of-way line of West Columbus Street to the Southeast corner of said Parcel 3; Thence Northwesterly along the Easterly line of said Parcel 3, 327.51 feet + to the Northeast corner of said ParceT 3, and the True Point of Beginning. 4. That pursuant to Section 1'7.52.200 of the Municipal Code of the City of Bakersfield, formal adoption of this Ordinance is deferred until the condition specified below is satisfied, and the above-described amendment to the Zoning Map and to Section 17.12.020 of the Municipal Code of the City of Bakersfield be, and hereby is, made subject to the following condition: Install a six-foot high chainlink fence to City standards along the east property line adjacent to the canal, or assurance of such improvement provided by way of contract (with adequate surety). This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. ......... 000 ..........
