AN ORDINANCE OF T%~E COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING TITLE FIVE OF THE
BAKERSFIELD MUNICIPAL CODE BY AMENDING
SECTION 5.40.030 RELATIVE TO THE CLOSING
HOURS OF POOL HALLS.
WHEREAS, the Bakersfield ~unicipal Code presently pro-
bibits use of public pool tables between the hours of two a.m.
(2:DO a.m.) and six a.m. (6:0(I a.m.); and
W~EREAS, where pool tables are merely incidental to a
restaurant or cafe business such restriction is not needed;
NOW, THEREFORE, BF IT ORDAINED by the Council of the
City of Bakersfield as follows:

That Section 5.40.030 of Chapter 5.40 of Title 5 of the
Bakersfield ~unicipal Code is hereby amended to read as follows:
5.40.O30 Closing hours.
It is unlawful for the owner, manager, employee or
other person having charge of any public pool hall or poolroom
defined as any p]ace open to the public where billiard:~ or pool
is played, to keep the same open or allow or permit tb.e same to
be kept open or allow any of the games or amusements to be played
or carried on therein between the hours of two a.~. an~J six a.m.
of any day, or to a]]ow any person, except the owner, manager,
employee or person in charge thereof, to be ar remain therein
between the hours mentioned in this section. The closing hours
provided in this secti~n shall not apply to an establishment
having four or ]ess pool tables where the establishment is a
restaurant or care which remains open to the public for twenty-
four hours Fer day.
~ECT[ON 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of 5t~ passage.
