AN EMERGENCY ORDINANCE OF THE COUNCIL OF THE
CITY OF BAKERSFIELD AMENDING SECTION 15.64.180
BAKERSFIELD MUNICIPAL CODE RELATIVE TO NOZZLES
FOR DISPENSING CLASS 1 LIQUIDS AT SELF-SERVICE
STATIONS.
WHEREAS, there are presently in use in the City of
Bakersfield at card-lock self-service gasoline stations nozzles
for the dispensing of Class 1 liquids (gasoline) which are equipped
with latch-open devices and which, as a result of such devices,
present a hazard to the public health and safety in the opinion
and Fire Marshal] of the City of Bakersfield;

WHEREAS,
existing provisions of the Bakersfield Municipal
Code prohibiting such latch-open devices at self-service stations
open to the public do not specifically extend such prohibition to
card-lock, key, or similar membership or account-only self-service
stations.
NOW THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
SECTION 1.
Section 15.64.180 of the Bakersfield Municipal Code
is hereby amended to read as follows:
15.64.180 Section 79.703(b) amended - Supervision
Section 79.703(b), Supervision, is amended to read:
1. If the dispensing of Class 1 liquids at a service
station available and open to the public or at a card-lock, key,
or similar membership or account-only service station is to be
done by a person other than a service station attendant, each
nozzle for the dispensing of such liquids shall be a listed
automatic-closing type without a latch-open device.
