AN ORDINANCE A~NDING TITLE SEVENTEEN OF THE
MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY
CHANGING THE LAND USE ZONING OF THAT CERTAIN
PROPERTY IN THE CITY OF BAKERSFIELD LOCATED
AT THE SOUTHWEST CORNER OF PLANZ ROAD AND
MADISON AVENUE.
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the City of
Bakersfield, the Planning Commission has held a public hearing on
a petition to change the land use zoning of that certain property
in the City of Bakersfield located at the Southwest corner of
Planz Road and Madison Avenue; and
WHEREAS, the Planning Commission, as a result of said
hearing, did make several general and specific findings of fact
which warranted a negative declaration of environmental impact
and a change of zoning of the subject property from R-1 (One
Family Dwelling) zone to an M-1 (Light Manufacturing) or more
restrictive zone and to a P (Automobile Parking) or more restrictive
zone, and the Council has considered said findings and all appear
to be true and correct; and
WHEREAS, there appears to be no substantial detrimental
environmental impact which could result from the proposed project;
and
WHEREAS, the City Council has determined after due con-
sideration of said petition and the recommendations of the Plan-
ning Commission herein on file, together with the reasons advanced
at the hearing for a change of zoning of said property, that a
zoning change should be authorized; and
WHEREAS, the City Council has determined and found that
this zoning ordinance is consistent with the General Plan of the
City of Bakersfield.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
1. All of the foregoinc~ recitals are hereby found to
be true and correct.
2. An environmental assessment was made of the project,
and a Negative Declaration was adopted by the Planning Commission
after a public hearing thereon, and this Council hereby approves
and adopts the Negative Declaration.
3. Section 17.06.020 (Zoning Map) of the Municipal
Code of the C~ty of Bakersfield be and the same is hereby amended
by changing the land use zoning of certain property in said City,
the boundaries of which property are shown on the map hereto
attached and made a part hereof, as follows:
FROM AN R-1 (ONE FAMILY DWELLING) ZONE TO
AN M-1 (LIGHT MANUFACTURING) OR MORE RE-
STRICTIVE ZONE AND TO A P (AUTOMOBILE
PARKING) OR MORE RESTRICTIVE ZONE:
All that portion of the East Half of Lot 3
of Kern County Sales Map No. 1 of Lands of
J. B. Haggin, filed May 3, 1889, in the
Office of the Kern County Recorder, State of
California;
Also being in Section 17, Township 30 South,
Range 28 East, M.D.B.&M., more particularly
described as follows:
TO A P ZONE:
Beginning at the Northeast corner of said
Lot 3;
Thence South 00006'48" East, 30 feet to the
Point of Beginning;
Thence continuing South 00~06'48" East, 465
feet + to a point, such point to be called
"Poin~ A" for the purposes of this description;
Thence North 31o09'47" West, 542.86 feet +
to the Southerly right-of-way line of Pla~z
Road;
Thence North 89°54'12" East, 280 feet + to
the Point of Beginning.
Containing + 1.5 acres.
TO AN M-1 ZONE:
Beginning at said Point A;
Thence South 00006'48" East, 204 feet +;
Thence North 54051'56" West, 817.02 fe~t to
the Southerly right-of-way line of Planz
Road;
Thence North 89°54'12" East, 189 feet +;
Thence South 31009'47" East, 542.86 feet +
to Point A.
Containing + 2.1 acres.

This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 2?th day of October , 1982, by
the following vote:
