A RESOLUTION DECLARING REAL PROPERTY
SURPLUS TO THE NEEDS OF THE CITY AND
AUTHORIZING THE FINANCE DIRECTOR TO
NEGOTIATE ITS SALE
WHEREAS, the City owns a fee simple interest in property south of McKee
Road and west of New Stine Road; and,
WHEREAS, Lennar Homes of California, Inc., a California corporation has
requested the City sell this property located at 5221 Barley Harvey Avenue, legally
described as Lot 87 of Tract 6290, Unit One, as shown on map recorded on December
13, 2005 in Book 54, Pages 94-96 inclusive of Tract Maps in the Kern County
Recorders Office to facilitate its new residential development.
WHEREAS, the Bakersfield Planning Department found the sale of this property
to be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to
Government Code Section 65402.
WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale
of City property deemed to be "surplus".
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The foregoing findings and recitals are true, correct, and incorporated
herein.
2. Real Property located is hereby declared surplus to the City's needs and
the Finance Director is authorized to negotiate its sale.
