Commissioner McGinnis, seconded by Commissioner Spencer, to approve the consent calendar non-public hearing items. Planning Commission - October 19, 2006 Page 2 Commissioner Blockley moved, seconded by Commissioner Spencer, to approve the public hearing consent calendar. Motion carried by the following roll call vote: AYES: Commissioners Blockley, McGinnis, Spencer, Tragish, Lomas. NOES:None. 5. PUBLIC HEARING — Receive comments on the adequacy of the Draft Environmental Impact Report (DEIR) for General Plan Amendment and Zone Change No. 06-0961 (Riverview) located east of Highway 184, between the extension of Edison Road on the west and Comanche Drive to the east. (Ward 3) The public hearing is opened. Staff report given. No one from the audience gave comments. The public hearing is closed. "Commissioner Tragish commented that in the Executive Summary of the Draft EIR under long term esthetic impacts sections 5.5-2 and 5.5-3 it summarizes that any future development would result in significant and unavoidable long term esthetic impacts. He stated that the summary on page 5/5.5-13, notwithstanding its conclusions provided that the potential view impairments to the foothills are not considered to be significant as future site development will be guided by the applicable Metropolitan Bakersfield General Plan Policies, as well as implementation action as set forth in the Land Use and Open Space Elements. Commissioner Tragish stated that he would like to have some examples of how this is going to be implemented in its application to the Metropolitan Bakersfield General Plan and Land Use and Open Space Elements." It was noted that Commissioner Tkac has arrived. Commissioner Tkac stated that he will refrain from voting as he did not hear this item. Commissioner McGinnis moved, seconded by Commissioner Blockley, to refer the above comments to Staff in preparation of a final EIR. Motion carried by the following roll call vote: AYES: Commissioners Blockley, McGinnis, Spencer, Tragish, Lomas. NOES: None. ABSTAINED: Commissioner Tkac 6. PUBLIC HEARING — Specific Parks and Trails Plan for Southwest Bakersfield — Old River Ranch (Smith/Tech USA) located between Berkshire and McKee Roads, and South Allen and Gosford Roads. (Categorically Exempt) (Continued from October 5, 2006 and re-advertised) The public hearing is opened. Staff report given. No one spoke in opposition to Staff's recommendation. Greg Petrini stated that he is in favor of Staff's recommendation. Thomas Fallgatter, representing the Grimm-Marshall family that owns property on the north side of Berkshire, stated they support Staff's recommendation. The public hearing is closed. Commissioner McGinnis stated he is in favor of the project. Commissioner McGinnis, seconded by Commissioner Tkac, to approve and adopt the Specific Parks and Trails Plan for Southwest Bakersfield in the vicinity of Old River Ranch development area as conditioned and amended by the Planning Director's memo dated October 18, 2006, and recommend the same to City Council. NON-PUBLIC HEARING AND PUBLIC HEARINGS —TENTATIVE TRACT MAPS NON-PUBLIC HEARING 7.1 Vesting Tentative Tract Map 6866 (Porter — Robertson Engineering & Surveying) (Note: The public hearing for this item was closed on October 5, 2006) Staff report given. Commissioner McGinnis inquired if it is typical on a new street to have the initial speed limit be 55 mph. Staff responded the initial speed limit is set by the requirements of state law. Mr. Walker further clarified that this is not a local street, but rather a two-lane connecting road. Mr. Walker stated that after it has been in use a survey can be done, which may indicate that it be a 35 mph road. Commissioner McGinnis inquired what would constitute the initiating of the study. Mr. Walker stated that it is the City's option as to when to do a study, but they have to have a minimum of 50 vehicles per hour to be able to take the study. Commissioner McGinnis stated that he would like to have the study done as soon as possible for safety reasons. Commissioner McGinnis stated that he has read Ant Hill Real Property's letter and proposal and agrees with their concessions in regard to the two-story homes. Commissioner Blockley stated he has also read the letter from Ant Hill Property and inquired of Fred Porter if it is their intent to accept a condition on the project limiting the subject lots to single story construction. Mr. Porter responded in the affirmative to those lots that were identified on the map submitted to the Planning Commission. Commissioner Tragish inquired if they can put a condition on the project as to when the traffic survey has to commence. Staff advised against such a condition. Commissioner Spencer inquired if Staff could show the recommended changes to the lots that will be restricted to single-story dwellings for the benefit of the audience. Staff gave an explanation. Commissioner Spencer inquired of the applicant, Mr. Porter, if there are any further problems and if the concerned residents to the north are satisfied. Mr. Porter responded that they don't know if it satisfies the concerns of the residents, however they believe that it should. Mr. Porter pointed out that his client has owned this property for a very long time, and while they want to be a good neighbor, they have to look at this from a viable, economic perspective and make sure that they don't paint themselves in a corner and drastically reduce the value of their project. Commissioner Spencer stated that he is in full support of this compromised proposal prepared by the engineer and the applicant. Commissioner Lomas reiterated that at this stage they are restricted, and they have to find a health and safety issue to require the applicant to do what they have offered to do. "Commissioner Tragish stated he agrees with Commissioner Lomas, but stated that he is not sure that there are restrictions on our findings, and by law there may be some leeway to discuss the impact to the single family residents; however the development has done his part to mitigate." Commissioner Blockley reiterated that the Planning Commission's hands are tied in this, and is glad to see that the applicant has volunteered to put this restriction that otherwise wouldn't be up for discussion. Commissioner Blockley moved, seconded by Commissioner Spencer, to approve vesting tentative tract map 6866 with findings and conditions set forth in the attached Resolution, Exhibit A, incorporating the three memos (two from Planning; one dated 9-28-06; the other 10-3-06. One from Public Works October 18, 2006, and the added condition that the applicant has consented to "prior to or concurrent with recordation of Phase I or 2, the developer shall record a covenant requiring that only a single story structure is allowed on each lot for lots 25 through 33 Phase 1, and lots 9 through 11 Phase 2, which are the lots along the north boundary. Subdivision shall place a Note on the final Map identifying these lots to Planning Commission - October 19, 2006 Page 4 be limited to single story only. The requirement for single story structures on the referenced lot will also be included in the development's CC&R's. Prior to recordation of any phase, the developer will provide a copy of the covenant and the CC&R's to the Planning Director and City Attorney for review and approval." PUBLIC HEARINGS 7.2 Vesting Tentative Tract Map 6377 -Phased (SmithTech USA, Inc) The public hearing is opened. Staff report given. No one spoke in opposition to Staff's recommendation. Bob Smith, with SmithTech USA, stated they are in favor of Staff's recommendation. The public hearing is closed. Commissioner Tragish moved, seconded by Commissioner Tkac, to approve vesting tentative tract map 6377 with findings and conditions set forth in the attached Resolution, Exhibit A, and incorporating Planning Director's memo dated October 12, 2006. Motion carried by the following roll call vote: AYES: Commissioners Blockley, McGinnis, Spencer, Tkac, Tragish, Lomas. Staff report given. No one spoke in opposition to Staff's recommendation. Bob Smith, with SmithTech USA, stated they are in favor of the project along with the conditions. COMMUNICATIONS: Mr. Movius advised that the Planning Development Committee of the City Council has looked at a draft ordinance from Staff regarding criteria for architectural and site design on shopping centers and big box facilities, and they have okay'd it to go to the Planning Commission with some tweaking. Mr. Movius further stated that the final EIR on the west side parkway will be coming to the Planning Commission in the near future for certification. Mr. Movius announced that Jim Eggert has been promoted to Assistant Planning Director. 9. COMMISSION COMMENTS: Commissioners Tragish and Blockley congratulated Mr. Eggert. Commissioner Lomas stated that she would like to address the drill island, landscaping and maintenance thereof. Planning Commission - October 19, 2006 Page 6 10.
